410 AN ACT
511 relating to the deployment of advanced metering and meter
612 information networks in certain areas outside of ERCOT.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter L, Chapter 39, Utilities Code, is
915 amended by adding Section 39.5521 to read as follows:
1016 Sec. 39.5521. METERING. (a) Notwithstanding Section
1117 39.552, an electric utility subject to this subchapter that elects
1218 to deploy advanced metering and meter information networks may
1319 recover reasonable and necessary costs incurred in deploying
1420 advanced metering and meter information networks. An electric
1521 utility that elects to deploy advanced metering or meter
1622 information networks is subject to commission rules adopted under
1723 Sections 39.107(h) and (k). The commission shall ensure that any
1824 deployment plan approved under this section and any related
1925 customer surcharge:
2026 (1) are not applicable to customer accounts that
2127 receive service at transmission voltage; and
2228 (2) are consistent with commission rules related to
2329 advanced metering systems regarding:
2430 (A) customer protections;
2531 (B) data security, privacy, and ownership; and
2632 (C) options given consumers to continue to
2733 receive service through a non-advanced meter.
2834 (b) An electric utility subject to this subchapter that
2935 elects to deploy an advanced meter information network shall deploy
3036 the network as rapidly as practicable to allow customers to better
3137 manage energy use and control costs.
3238 SECTION 2. This Act takes effect immediately if it receives
3339 a vote of two-thirds of all the members elected to each house, as
3440 provided by Section 39, Article III, Texas Constitution. If this
3541 Act does not receive the vote necessary for immediate effect, this
3642 Act takes effect September 1, 2019.
