66 AN ACT
77 relating to the name and governance of the Railroad Commission of
88 Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 81, Natural Resources
1111 Code, is amended to read as follows:
1212 CHAPTER 81. TEXAS ENERGY RESOURCES [RAILROAD] COMMISSION [OF TEXAS]
1313 SECTION 2. Section 81.001, Natural Resources Code, is
1414 amended to read as follows:
1515 Sec. 81.001. DEFINITIONS. In this chapter:
1616 (1) "Commission" means the Texas Energy Resources
1717 [Railroad] Commission [of Texas].
1818 (2) "Commissioner" means any member of the Texas
1919 Energy Resources [Railroad] Commission [of Texas].
2020 SECTION 3. Subchapter A, Chapter 81, Natural Resources
2121 Code, is amended by adding Section 81.003 to read as follows:
2222 Sec. 81.003. TEXAS ENERGY RESOURCES COMMISSION. (a) The
2323 Railroad Commission of Texas is renamed the Texas Energy Resources
2424 Commission.
2525 (b) A reference in law to:
2626 (1) the Railroad Commission of Texas means the Texas
2727 Energy Resources Commission; and
2828 (2) a railroad commissioner or a member of the
2929 Railroad Commission of Texas means a member of the Texas Energy
3030 Resources Commission.
3131 SECTION 4. Sections 81.01001(a) and (b), Natural Resources
3232 Code, are amended to read as follows:
3333 (a) The Texas Energy Resources [Railroad] Commission [of
3434 Texas] is subject to Chapter 325, Government Code (Texas Sunset
3535 Act). Unless continued in existence as provided by that chapter,
3636 the commission is abolished September 1, 2029.
3737 (b) The Texas Energy Resources [Railroad] Commission [of
3838 Texas] shall pay the costs incurred by the Sunset Advisory
3939 Commission in performing a review of the commission under this
4040 section. The Sunset Advisory Commission shall determine the
4141 costs, and the commission shall pay the amount of those costs
4242 promptly on receipt of a statement from the Sunset Advisory
4343 Commission detailing the costs.
4444 SECTION 5. Subchapter B, Chapter 81, Natural Resources
4545 Code, is amended by adding Section 81.010015 to read as follows:
4646 Sec. 81.010015. ELECTION AND TERMS OF COMMISSIONERS;
4747 VACANCIES. (a) The commission is composed of three commissioners
4848 elected at the general election for state and county officers.
4949 (b) Commissioners serve staggered terms of six years, with
5050 the term of one commissioner expiring December 31 of each
5151 even-numbered year.
5252 (c) The governor shall appoint a person to fill a vacancy on
5353 the commission until the next general election.
5454 SECTION 6. Section 81.01005, Natural Resources Code, is
5555 amended to read as follows:
5656 Sec. 81.01005. NAME AND SEAL. (a) The commissioners are
5757 known collectively as the "Texas Energy Resources [Railroad]
5858 Commission [of Texas]."
5959 (b) The seal of the commission contains a star of five
6060 points with the words "Texas Energy Resources [Railroad] Commission
6161 [of Texas]" engraved on it.
6262 SECTION 7. The heading to Section 81.0521, Natural
6363 Resources Code, is amended to read as follows:
6464 Sec. 81.0521. FEE FOR APPLICATION FOR EXCEPTION TO
6565 [RAILROAD] COMMISSION RULE.
6666 SECTION 8. Section 52.092(c), Election Code, is amended to
6767 read as follows:
6868 (c) Statewide offices of the state government shall be
6969 listed in the following order:
7070 (1) governor;
7171 (2) lieutenant governor;
7272 (3) attorney general;
7373 (4) comptroller of public accounts;
7474 (5) commissioner of the General Land Office;
7575 (6) commissioner of agriculture;
7676 (7) energy resources [railroad] commissioner;
7777 (8) chief justice, supreme court;
7878 (9) justice, supreme court;
7979 (10) presiding judge, court of criminal appeals;
8080 (11) judge, court of criminal appeals.
8181 SECTION 9. On the effective date of this Act, the name of
8282 the Railroad Commission of Texas is changed to the Texas Energy
8383 Resources Commission. The change of the agency's name does not
8484 affect:
8585 (1) the agency's powers, duties, rights, or
8686 obligations;
8787 (2) the agency's personnel, equipment, data,
8888 documents, facilities, contracts, items, other property,
8989 appropriations, rules, or decisions;
9090 (3) a proceeding of or involving the agency under the
9191 name of the Railroad Commission of Texas; or
9292 (4) the terms of the chairman or other members of the
9393 governing body of the agency.
9494 SECTION 10. This Act takes effect September 1, 2019.
