66 AN ACT
77 relating to the posting by the Railroad Commission of Texas on its
88 Internet website of certain enforcement information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 81, Natural Resources
1111 Code, is amended by adding Section 81.073 to read as follows:
1212 Sec. 81.073. ENFORCEMENT INFORMATION. (a) The commission
1313 shall post on the commission's Internet website:
1414 (1) comprehensive information regarding the
1515 commission's enforcement of this title and rules, orders, licenses,
1616 permits, and certificates issued under this title, including
1717 information regarding:
1818 (A) inspection and enforcement activity;
1919 (B) violations; and
2020 (C) the amount of penalties finally assessed;
2121 (2) information evidencing quarterly trends regarding
2222 enforcement activity by the commission, including:
2323 (A) the number of complaints received and the
2424 manner in which they were resolved;
2525 (B) the total number of inspections conducted,
2626 the number of inspections conducted following the receipt of a
2727 complaint, and the number of inspections conducted on the
2828 commission's own initiative;
2929 (C) the number of violations, categorized
3030 according to the degree of severity of the violation and the
3131 statute, rule, order, license, permit, or certificate violated, for
3232 which enforcement action has been taken;
3333 (D) the number of repeat violations determined to
3434 have been committed; and
3535 (E) the number of violations referred to the
3636 attorney general for enforcement; and
3737 (3) an analysis of annual trends regarding complaints
3838 filed with the commission and enforcement activity by the
3939 commission.
4040 (b) Information required to be posted under this section
4141 must be:
4242 (1) in a searchable format;
4343 (2) organized by county, by operator or other entity,
4444 and by well, if applicable; and
4545 (3) capable of being downloaded in bulk.
4646 SECTION 2. The Railroad Commission of Texas shall comply
4747 with Section 83.073(b), Natural Resources Code, as added by this
4848 Act, not later than January 1, 2021.
4949 SECTION 3. This Act takes effect September 1, 2019.
