6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 13 | | SECTION 1. Section 1067.051(a), Special District Local Laws |
---|
8 | 14 | | Code, is amended to read as follows: |
---|
9 | 15 | | (a) The district consists of seven [nine] elected |
---|
10 | 16 | | directors. |
---|
11 | 17 | | SECTION 2. Sections 1067.055(a), (b), (d), and (e), Special |
---|
12 | 18 | | District Local Laws Code, are amended to read as follows: |
---|
13 | 19 | | (a) The board shall elect one of the directors as [a] |
---|
14 | 20 | | president and one director as vice president-secretary [a vice |
---|
15 | 21 | | president from among its members]. |
---|
16 | 22 | | (b) The vice president-secretary [board] shall act as |
---|
17 | 23 | | [appoint] a secretary of the board [, who need not be a director]. |
---|
18 | 24 | | (d) The president [is the chief executive officer of the |
---|
19 | 25 | | district and] has the same right to vote as any other director. |
---|
20 | 26 | | (e) If the president is absent or fails and declines to act, |

21 | 27 | | the vice president-secretary [vice president] shall perform the |
---|
22 | 28 | | president's duties and exercise the president's powers under this |

41 | 47 | | officer's [administrator's] duties, to execute a bond payable to |

42 | 48 | | the district in an amount set by the board of not less than $5,000 |

44 | 50 | | (1) is conditioned on the faithful performance of the |
---|
45 | 51 | | chief executive officer's [administrator's] duties; and |
---|
46 | 52 | | (2) contains other conditions the board may require. |

47 | 53 | | SECTION 5. Section 1067.058, Special District Local Laws |
---|
48 | 54 | | Code, is amended to read as follows: |

49 | 55 | | Sec. 1067.058. GENERAL DUTIES OF CHIEF EXECUTIVE OFFICER |
---|
50 | 56 | | [DISTRICT ADMINISTRATOR]. Subject to the limitations prescribed by |
---|
51 | 57 | | the board, the chief executive officer [district administrator] |
---|
52 | 58 | | shall: |
---|
53 | 59 | | (1) supervise the work and activities of the hospital; |
---|
54 | 60 | | and |
---|
55 | 61 | | (2) direct the affairs of the district. |
---|
56 | 62 | | SECTION 6. Sections 1067.059(a) and (b), Special District |
---|
57 | 63 | | Local Laws Code, are amended to read as follows: |
---|
58 | 64 | | (a) The board, with the chief executive officer [district |
---|
59 | 65 | | administrator], may appoint to the staff any doctors the board |
---|
60 | 66 | | considers necessary for the efficient operation of the district. |
---|
61 | 67 | | (b) The board may employ technicians, nurses, and other |
---|
62 | 68 | | employees as considered necessary for the efficient operation of |
---|
63 | 69 | | the hospital or may provide that the chief executive officer |
---|
64 | 70 | | [district administrator] has the authority to admit or employ those |
---|
65 | 71 | | persons. |
---|
66 | 72 | | SECTION 7. Sections 1067.111(a), (b), (c), (d), and (e), |
---|
67 | 73 | | Special District Local Laws Code, are amended to read as follows: |
---|
68 | 74 | | (a) When an indigent patient who resides in the district is |
---|
69 | 75 | | admitted to a district facility or a person who does not reside in |
---|
70 | 76 | | the district is admitted as an emergency patient to a district |
---|
71 | 77 | | facility, the chief executive officer [district administrator] |
---|
72 | 78 | | shall have an inquiry made into the circumstances of: |
---|
73 | 79 | | (1) the patient; and |
---|
74 | 80 | | (2) the patient's relatives who are legally liable for |
---|
75 | 81 | | the patient's support. |
---|
76 | 82 | | (b) If the chief executive officer [district administrator] |
---|
77 | 83 | | determines that the patient or those relatives cannot pay all or |
---|
78 | 84 | | part of the costs of the care and treatment in the hospital, the |
---|
79 | 85 | | amount of the costs that cannot be paid becomes a charge against the |
---|
80 | 86 | | district as care for indigents. |
---|
81 | 87 | | (c) If the chief executive officer [district administrator] |
---|
82 | 88 | | determines that the patient or those relatives can pay for all or |
---|
83 | 89 | | part of the costs of the patient's care and treatment, the patient |
---|
84 | 90 | | or those relatives shall be ordered to pay the district a specified |
---|
85 | 91 | | amount each week for the patient's support. The amount ordered must |
---|
86 | 92 | | be proportionate to the person's financial ability and may not |
---|
87 | 93 | | exceed the actual per capita cost of maintenance. |
---|
88 | 94 | | (d) The chief executive officer [district administrator] |
---|
89 | 95 | | may collect the amount from the patient's estate, or from any |
---|
90 | 96 | | relative who is legally liable for the patient's support, in the |
---|
91 | 97 | | manner provided by law for the collection of expenses of the last |
---|
92 | 98 | | illness of a deceased person. |
---|
93 | 99 | | (e) If there is a dispute as to the ability to pay, or doubt |
---|
94 | 100 | | in the mind of the chief executive officer [district |
---|
95 | 101 | | administrator], the board shall hold a hearing and, after calling |
---|
96 | 102 | | witnesses, shall: |
---|
97 | 103 | | (1) resolve the dispute or doubt; and |
---|
98 | 104 | | (2) issue any appropriate orders. |
---|
99 | 105 | | SECTION 8. Section 1067.152(b), Special District Local Laws |
---|
100 | 106 | | Code, is amended to read as follows: |
---|
101 | 107 | | (b) The board shall adopt a budget by acting on the budget |
---|
102 | 108 | | proposed by the chief executive officer [district administrator]. |
---|
103 | 109 | | SECTION 9. Section 1067.205(b), Special District Local Laws |
---|
104 | 110 | | Code, is amended to read as follows: |
---|
105 | 111 | | (b) The vice president-secretary [board secretary] shall |
---|
106 | 112 | | attest the bonds as provided by Chapter 618, Government Code. |
---|
107 | 113 | | SECTION 10. Sections 1067.307(b) and (c), Special District |
---|
108 | 114 | | Local Laws Code, are amended to read as follows: |
---|
109 | 115 | | (b) On the payment of all outstanding debts and obligations |
---|
110 | 116 | | of the district, the board shall order the vice president-secretary |
---|
111 | 117 | | [secretary] to return to each district taxpayer the taxpayer's pro |
---|
112 | 118 | | rata share of all unused tax money. |
---|
113 | 119 | | (c) A taxpayer may request that the taxpayer's share of |
---|
114 | 120 | | surplus tax money be credited to the taxpayer's county taxes. If a |
---|
115 | 121 | | taxpayer requests the credit, the board shall direct the vice |
---|
116 | 122 | | president-secretary [secretary] to transmit the money to the county |
---|
117 | 123 | | tax assessor-collector. |
---|
118 | 124 | | SECTION 11. (a) The election of the board of directors of |
---|
119 | 125 | | the Muenster Hospital District scheduled to be held in May 2020 must |
---|
120 | 126 | | be held. One director shall be elected at that election and shall |
---|
121 | 127 | | serve a three-year term. |
---|
122 | 128 | | (b) The election of the board of directors of the Muenster |
---|
123 | 129 | | Hospital District scheduled to be held in May 2021 must be held, and |
---|
124 | 130 | | three directors shall be elected at that election. The directors |
---|
125 | 131 | | elected at that election shall draw lots to determine which two |
---|
126 | 132 | | directors serve three-year terms and which director serves a |
---|
127 | 133 | | two-year term. |
---|
128 | 134 | | (c) The election of the board of directors of the Muenster |
---|
129 | 135 | | Hospital District scheduled to be held in May 2022 must be held, and |
---|
130 | 136 | | the three directors elected at that election shall serve three-year |
---|
131 | 137 | | terms. |
---|
132 | 138 | | (d) The directors of the Muenster Hospital District elected |
---|
133 | 139 | | at the elections scheduled to be held in May 2023, May 2024, and May |
---|
134 | 140 | | 2025 shall serve three-year terms. |
---|
135 | 141 | | SECTION 12. This Act takes effect immediately if it |
---|
136 | 142 | | receives a vote of two-thirds of all the members elected to each |
---|
137 | 143 | | house, as provided by Section 39, Article III, Texas Constitution. |
---|
138 | 144 | | If this Act does not receive the vote necessary for immediate |
---|
139 | 145 | | effect, this Act takes effect September 1, 2019. |
---|
