| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 32.024, Human Resources Code, is amended | |
| 11 | 11 | by amending Subsection (e) and adding Subsection (mm) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (e) The commission may not authorize the provision of any | |
| 14 | 14 | service to any person under the program unless federal matching | |
| 15 | 15 | funds are available to pay the cost of the service, except that the | |
| 16 | 16 | commission shall provide abortion services regardless of whether | |
| 17 | 17 | federal matching funds are available to pay for the cost of those | |
| 18 | 18 | services. | |
| 19 | 19 | (mm) The commission shall provide abortion services under | |
| 20 | 20 | the medical assistance program in accordance with applicable state | |
| 21 | 21 | and federal law. | |
| 22 | 22 | SECTION 2. Section 32.005, Health and Safety Code, and | |
| 23 | 23 | Section 32.024(c-1), Human Resources Code, are repealed. | |
| 24 | 24 | SECTION 3. If before implementing any provision of this Act | |
| 25 | 25 | a state agency determines that a waiver or authorization from a | |
| 26 | 26 | federal agency is necessary for implementation of that provision, | |
| 27 | 27 | the agency affected by the provision shall request the waiver or | |
| 28 | 28 | authorization and may delay implementing that provision until the | |
| 29 | 29 | waiver or authorization is granted. | |
| 30 | 30 | SECTION 4. This Act takes effect September 1, 2019. |
