99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 28A, Water Code, is
1111 amended to read as follows:
1212 CHAPTER 28A. REGULATION [REGISTRATION AND INSPECTION] OF CERTAIN
1313 AGGREGATE PRODUCTION OPERATIONS
1414 SECTION 2. The heading to Subchapter B, Chapter 28A, Water
1515 Code, is amended to read as follows:
1616 SUBCHAPTER B. REGISTRATION, [AND] INSPECTION, AND BEST PRACTICES
1717 SECTION 3. Subchapter B, Chapter 28A, Water Code, is
1818 amended by adding Section 28A.055 to read as follows:
1919 Sec. 28A.055. BEST MANAGEMENT PRACTICES. The commission
2020 shall adopt and make accessible on the commission's Internet
2121 website best management practices for aggregate production
2222 operations to comply with applicable environmental laws and rules.
2323 SECTION 4. As soon as practicable after the effective date
2424 of this Act, the Texas Commission on Environmental Quality shall
2525 adopt the best management practices required under Section 28A.055,
2626 Water Code, as added by this Act.
2727 SECTION 5. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2019.
