	9	+	A BILL TO BE ENTITLED
4	10		AN ACT
5	11		relating to the enforcement of commercial motor vehicle safety
6	12		standards in certain municipalities and counties.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 644.101(b), Transportation Code, as
9	15		amended by Chapters 138 (H.B. 1355), 142 (H.B. 1570), and 324 (S.B.
10	16		1488), Acts of the 85th Legislature, Regular Session, 2017, is
11	17		reenacted and amended to read as follows:
12	18		(b) A police officer of any of the following municipalities
13	19		is eligible to apply for certification under this section:
14	20		(1) a municipality with a population of 50,000 or
15	21		more;
16	22		(2) a municipality with a population of 25,000 or more
17	23		any part of which is located in a county with a population of
18	24		500,000 or more;
19	25		(3) a municipality with a population of less than
20	26		25,000:
21	27		(A) any part of which is located in a county with
22	28		a population of 3.3 million; and
23	29		(B) that contains or is adjacent to an
24	30		international port;
25	31		(4) a municipality with a population of at least
26	32		34,000 that is located in a county that borders two or more states;
27	33		(5) a municipality any part of which is located in a
28	34		county bordering the United Mexican States;
29	35		(6) a municipality with a population of less than
30	36		5,000 that is located:
31	37		(A) adjacent to a bay connected to the Gulf of
32	38		Mexico; and
33	39		(B) in a county adjacent to a county with a
34	40		population greater than 3.3 million;
35	41		(7) a municipality that is located:
36	42		(A) within 25 miles of an international port; and
37	43		(B) in a county that does not contain a highway
38	44		that is part of the national system of interstate and defense
39	45		highways and is adjacent to a county with a population greater than
40	46		3.3 million;
41	47		(8) a municipality with a population of less than
42	48		8,500 that:
43	49		(A) is the county seat; and
44	50		(B) contains a highway that is part of the
45	51		national system of interstate and defense highways;
46	52		(9) a municipality located in a county with a
47	53		population between 60,000 and 66,000 adjacent to a bay connected to
48	54		the Gulf of Mexico;
49	55		(10) a municipality with a population of more than
50	56		40,000 and less than 50,000 that is located in a county with a
51	57		population of more than 285,000 and less than 300,000 that borders
52	58		the Gulf of Mexico; [or]
53	59		(11) a municipality with a population between 18,000
54	60		and 18,500 that is located entirely in a county that:
55	61		(A) has a population of less than 200,000;
56	62		(B) is adjacent to two counties that each have a
57	63		population of more than 1.2 million; and
58	64		(C) contains two highways that are part of the
59	65		national system of interstate and defense highways;
60	66		(12) [(11)] a municipality with a population of more
61	67		than 3,000 and less than 10,000 that:
62	68		(A) contains a highway that is part of the
63	69		national system of interstate and defense highways; and
64	70		(B) is located in a county with a population
65	71		between 150,000 and 155,000; or
66	72		(13) a municipality with a population of less than
67	73		50,000 that is located in:
68	74		(A) a county that generated $20 million or more
69	75		in tax revenue collected under Chapters 201 and 202, Tax Code, from
70	76		oil and gas production during the preceding state fiscal year; or
71	77		(B) a county that is adjacent to two or more
72	78		counties described by Paragraph (A).
73	79		SECTION 2. Section 644.101(c), Transportation Code, is
74	80		amended to read as follows:
75	81		(c) A sheriff or a deputy sheriff of any of the following
76	82		counties [a county bordering the United Mexican States or of a
77	83		county with a population of 700,000 or more] is eligible to apply
78	84		for certification under this section:
79	85		(1) a county bordering the United Mexican States;
80	86		(2) a county with a population of less than 1,000, part
81	87		of which is located within 75 miles of an international border; or
82	88		(3) a county with a population of 700,000 or more.
83	89		SECTION 3. To the extent of any conflict, this Act prevails
84	90		over another Act of the 86th Legislature, Regular Session, 2019,
85	91		relating to nonsubstantive additions to and corrections in enacted
86	92		codes.
87	93		SECTION 4. This Act takes effect September 1, 2019.
