9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the enforcement of commercial motor vehicle safety
612 standards in certain municipalities and counties.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 644.101(b), Transportation Code, as
915 amended by Chapters 138 (H.B. 1355), 142 (H.B. 1570), and 324 (S.B.
1016 1488), Acts of the 85th Legislature, Regular Session, 2017, is
1117 reenacted and amended to read as follows:
1218 (b) A police officer of any of the following municipalities
1319 is eligible to apply for certification under this section:
1420 (1) a municipality with a population of 50,000 or
1521 more;
1622 (2) a municipality with a population of 25,000 or more
1723 any part of which is located in a county with a population of
1824 500,000 or more;
1925 (3) a municipality with a population of less than
2026 25,000:
2127 (A) any part of which is located in a county with
2228 a population of 3.3 million; and
2329 (B) that contains or is adjacent to an
2430 international port;
2531 (4) a municipality with a population of at least
2632 34,000 that is located in a county that borders two or more states;
2733 (5) a municipality any part of which is located in a
2834 county bordering the United Mexican States;
2935 (6) a municipality with a population of less than
3036 5,000 that is located:
3137 (A) adjacent to a bay connected to the Gulf of
3238 Mexico; and
3339 (B) in a county adjacent to a county with a
3440 population greater than 3.3 million;
3541 (7) a municipality that is located:
3642 (A) within 25 miles of an international port; and
3743 (B) in a county that does not contain a highway
3844 that is part of the national system of interstate and defense
3945 highways and is adjacent to a county with a population greater than
4046 3.3 million;
4147 (8) a municipality with a population of less than
4248 8,500 that:
4349 (A) is the county seat; and
4450 (B) contains a highway that is part of the
4551 national system of interstate and defense highways;
4652 (9) a municipality located in a county with a
4753 population between 60,000 and 66,000 adjacent to a bay connected to
4854 the Gulf of Mexico;
4955 (10) a municipality with a population of more than
5056 40,000 and less than 50,000 that is located in a county with a
5157 population of more than 285,000 and less than 300,000 that borders
5258 the Gulf of Mexico; [or]
5359 (11) a municipality with a population between 18,000
5460 and 18,500 that is located entirely in a county that:
5561 (A) has a population of less than 200,000;
5662 (B) is adjacent to two counties that each have a
5763 population of more than 1.2 million; and
5864 (C) contains two highways that are part of the
5965 national system of interstate and defense highways;
6066 (12) [(11)] a municipality with a population of more
6167 than 3,000 and less than 10,000 that:
6268 (A) contains a highway that is part of the
6369 national system of interstate and defense highways; and
6470 (B) is located in a county with a population
6571 between 150,000 and 155,000; or
6672 (13) a municipality with a population of less than
6773 50,000 that is located in:
6874 (A) a county that generated $20 million or more
6975 in tax revenue collected under Chapters 201 and 202, Tax Code, from
7076 oil and gas production during the preceding state fiscal year; or
7177 (B) a county that is adjacent to two or more
7278 counties described by Paragraph (A).
7379 SECTION 2. Section 644.101(c), Transportation Code, is
7480 amended to read as follows:
7581 (c) A sheriff or a deputy sheriff of any of the following
7682 counties [a county bordering the United Mexican States or of a
7783 county with a population of 700,000 or more] is eligible to apply
7884 for certification under this section:
7985 (1) a county bordering the United Mexican States;
8086 (2) a county with a population of less than 1,000, part
8187 of which is located within 75 miles of an international border; or
8288 (3) a county with a population of 700,000 or more.
8389 SECTION 3. To the extent of any conflict, this Act prevails
8490 over another Act of the 86th Legislature, Regular Session, 2019,
8591 relating to nonsubstantive additions to and corrections in enacted
8692 codes.
8793 SECTION 4. This Act takes effect September 1, 2019.
