67 AN ACT
78 relating to a public school campus's election under a campus
89 turnaround plan to operate as a community school.
910 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1011 SECTION 1. Subchapter C, Chapter 39A, Education Code, is
1112 amended by adding Section 39A.1011 to read as follows:
1213 Sec. 39A.1011. CAMPUS TURNAROUND PLAN TO OPERATE AS
1314 COMMUNITY SCHOOL. (a) A campus turnaround plan may permit a campus
1415 to operate as a community school. A plan to operate as a community
1516 school must include, in addition to the other requirements of this
1617 subchapter, strategies and programs to coordinate academic,
1718 social, and health services and reduce barriers to learning through
1819 partnerships and service coordination.
1920 (b) Programs and services offered by a campus operating as a
2021 community school under a campus turnaround plan may include:
2122 (1) early childhood education;
2223 (2) after-school and summer school academic and
2324 enrichment programs;
2425 (3) college and career preparation;
2526 (4) service learning opportunities, such as
2627 internships and community service programs;
2728 (5) leadership and mentoring programs;
2829 (6) activities to encourage community and parent
29- engagement in students' education; and
30- (7) parenting classes.
30+ engagement in students' education;
31+ (7) health and social services for students and their
32+ families; and
33+ (8) parenting classes.
3134 (c) A campus that elects to operate as a community school
3235 under a campus turnaround plan must:
3336 (1) establish a school community partnership team,
3437 composed of the members required for a campus-level planning and
3538 decision-making committee under Section 11.251 and additional
3639 community representatives, to coordinate with the campus
3740 intervention team for the campus;
3841 (2) establish a partnership with a lead organization
3942 that has experience in developing and implementing a community
4043 school plan;
4144 (3) designate a school district employee or an
4245 employee of an organization with experience in developing and
4346 implementing a community school plan as the community school
4447 coordinator for the campus, whose duties must include the
4548 recruitment and coordination of services from community partners;
4649 (4) develop a community school plan that satisfies the
4750 requirements for a campus improvement plan under Section 11.253;
4851 and
4952 (5) obtain approval for the community school plan
5053 from:
5154 (A) at least 75 percent of campus faculty and
5255 staff and 75 percent of parents of students enrolled at the campus;
5356 and
5457 (B) the board of trustees of the school district
5558 in which the campus is located.
5659 SECTION 2. Section 39A.107, Education Code, is amended by
5760 adding Subsection (d) to read as follows:
58- (d) Notwithstanding Subsection (c), instead of ordering the
59- closure of the campus, the commissioner may give the campus:
60- (1) the opportunity to operate as a community school
61- under a campus turnaround plan as provided by Section 39A.1011; and
62- (2) if the campus elects to operate as a community
63- school as described by Subdivision (1), at least two years to
64- implement the campus's community school plan.
61+ (d) Notwithstanding Subsection (c), the commissioner may
62+ not order the closure of a campus under this section without giving
63+ the campus the opportunity to operate as a community school under a
64+ campus turnaround plan as provided by Section 39A.1011 and at least
65+ two years to implement the campus's community school plan.
6566 SECTION 3. Section 39A.111, Education Code, is amended to
6667 read as follows:
6768 Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING.
6869 (a) If a campus is considered to have an unacceptable performance
6970 rating for three consecutive school years after the campus is
7071 ordered to submit a campus turnaround plan under Section 39A.101,
7172 the commissioner, subject to Section 39A.112, shall order:
7273 (1) appointment of a board of managers to govern the
7374 school district as provided by Section 39A.202; or
7475 (2) closure of the campus.
75- (b) Notwithstanding Subsection (a), instead of ordering the
76- closure of the campus, the commissioner may give the campus:
77- (1) the opportunity to operate as a community school
78- under a campus turnaround plan as provided by Section 39A.1011; and
79- (2) if the campus elects to operate as a community
80- school as described by Subdivision (1), at least two years to
81- implement the campus's community school plan.
76+ (b) Notwithstanding Subsection (a), the commissioner may
77+ not order the closure of a campus under this section without giving
78+ the campus the opportunity to operate as a community school under a
79+ campus turnaround plan as provided by Section 39A.1011 and at least
80+ two years to implement the campus's community school plan.
8281 SECTION 4. This Act takes effect immediately if it receives
8382 a vote of two-thirds of all the members elected to each house, as
8483 provided by Section 39, Article III, Texas Constitution. If this
8584 Act does not receive the vote necessary for immediate effect, this
8685 Act takes effect September 1, 2019.
