86 AN ACT
9- relating to a study on reducing the level at which the air
10- temperature in facilities operated by the Texas Department of
11- Criminal Justice is regulated.
7+ relating to the temperature at which a facility operated by the
8+ Texas Department of Criminal Justice is maintained.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Subchapter A, Chapter 501, Government Code, is
1411 amended by adding Section 501.026 to read as follows:
15- Sec. 501.026. STUDY ON REDUCING AIR TEMPERATURE IN
16- FACILITIES OPERATED BY DEPARTMENT. (a) The department shall
17- contract with a qualified independent vendor to conduct a study on
18- reducing the air temperature in facilities operated by the
19- department. The study must:
20- (1) identify the most cost-effective measures to
21- reduce the air temperature;
22- (2) estimate the costs to the department of
23- implementing those measures; and
24- (3) estimate the amount of time necessary to implement
25- those measures.
26- (b) Not later than August 31, 2020, the department shall
27- prepare and submit to the governor, the lieutenant governor, the
28- speaker of the house of representatives, and each standing
29- committee of the legislature having primary jurisdiction over the
30- department a written report that summarizes the results of the
31- study conducted under this section.
32- (c) This section expires January 1, 2021.
33- SECTION 2. This Act takes effect immediately if it receives
12+ Sec. 501.026. TEMPERATURE REQUIREMENTS AT DEPARTMENT
13+ FACILITIES. The department shall ensure that the temperature in
14+ each facility operated by the department is maintained at not less
15+ than 65 degrees Fahrenheit or more than 85 degrees Fahrenheit.
16+ SECTION 2. The Texas Department of Criminal Justice is not
17+ required to comply with the requirements of Section 501.026,
18+ Government Code, as added by this Act, until September 1, 2020.
19+ SECTION 3. This Act takes effect immediately if it receives
3420 a vote of two-thirds of all the members elected to each house, as
3521 provided by Section 39, Article III, Texas Constitution. If this
3622 Act does not receive the vote necessary for immediate effect, this
3723 Act takes effect September 1, 2019.
