77 relating to a child-care facility database on the Health and Human
88 Services Commission's Internet website.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 42, Human Resources Code,
1111 is amended by adding Section 42.026 to read as follows:
1212 Sec. 42.026. SEARCHABLE CHILD-CARE FACILITY DATABASE. (a)
1313 The commission shall establish on the commission's Internet website
1414 a searchable database that allows an individual to obtain
1515 information on the child-care facilities and residential
1616 child-care facilities licensed under this chapter and the family
1717 homes registered or listed under this chapter. To assist the
1818 individual in making an informed decision when selecting child
1919 care, the database must be easily accessible and allow a person to
2020 search the database by facility or home name, operation type, and
2121 location and by the ages of children served at the facility or home.
2222 (b) For each child-care facility and residential child-care
2323 facility licensed under this chapter and each family home
2424 registered or listed under this chapter, the database must include:
2525 (1) information on whether the facility or home has
2626 sufficient liability insurance coverage for the number of children
2727 the facility or home is authorized to serve under its license or
2828 registration;
2929 (2) information on whether the facility or home has
3030 surveillance cameras that provide adequate observation of
3131 caregiver and child activity;
3232 (3) the caregiver-to-child ratio and the date this
3333 ratio was last measured by the commission;
3434 (4) a link to commission investigative reports on the
3535 commission's Internet website; and
3636 (5) information on whether all facility or home
3737 personnel have undergone criminal history record checks and the
3838 date the commission verified compliance with required checks.
3939 (c) The executive commissioner may adopt rules as necessary
4040 to implement this section.
4141 SECTION 2. Not later than September 30, 2019, the Health and
4242 Human Services Commission shall establish the database on its
4343 Internet website as required by Section 42.026, Human Resources
4444 Code, as added by this Act.
4545 SECTION 3. This Act takes effect September 1, 2019.
