| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 42, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 42.026 to read as follows: |
|---|
| 12 | 12 | | Sec. 42.026. SEARCHABLE CHILD-CARE FACILITY DATABASE. (a) |
|---|
| 13 | 13 | | The commission shall establish on the commission's Internet website |
|---|
| 14 | 14 | | a searchable database that allows an individual to obtain |
|---|
| 15 | 15 | | information on the child-care facilities and residential |
|---|
| 16 | 16 | | child-care facilities licensed under this chapter and the family |
|---|
| 17 | 17 | | homes registered or listed under this chapter. To assist the |
|---|
| 18 | 18 | | individual in making an informed decision when selecting child |
|---|
| 19 | 19 | | care, the database must be easily accessible and allow a person to |
|---|
| 20 | 20 | | search the database by facility or home name, operation type, and |
|---|
| 21 | 21 | | location and by the ages of children served at the facility or home. |
|---|
| 22 | 22 | | (b) For each child-care facility and residential child-care |
|---|
| 23 | 23 | | facility licensed under this chapter and each family home |
|---|
| 24 | 24 | | registered or listed under this chapter, the database must include: |
|---|
| 25 | 25 | | (1) information on whether the facility or home has |
|---|
| 26 | 26 | | sufficient liability insurance coverage for the number of children |
|---|
| 27 | 27 | | the facility or home is authorized to serve under its license or |
|---|
| 28 | 28 | | registration; |
|---|
| 29 | 29 | | (2) information on whether the facility or home has |
|---|
| 30 | 30 | | surveillance cameras that provide adequate observation of |
|---|
| 31 | 31 | | caregiver and child activity; |
|---|
| 32 | 32 | | (3) the caregiver-to-child ratio and the date this |
|---|
| 33 | 33 | | ratio was last measured by the commission; |
|---|
| 34 | 34 | | (4) a link to commission investigative reports on the |
|---|
| 35 | 35 | | commission's Internet website; and |
|---|
| 36 | 36 | | (5) information on whether all facility or home |
|---|
| 37 | 37 | | personnel have undergone criminal history record checks and the |
|---|
| 38 | 38 | | date the commission verified compliance with required checks. |
|---|
| 39 | 39 | | (c) The executive commissioner may adopt rules as necessary |
|---|
| 40 | 40 | | to implement this section. |
|---|
| 41 | 41 | | SECTION 2. Not later than September 30, 2019, the Health and |
|---|
| 42 | 42 | | Human Services Commission shall establish the database on its |
|---|
| 43 | 43 | | Internet website as required by Section 42.026, Human Resources |
|---|
| 44 | 44 | | Code, as added by this Act. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2019. |
