55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain contributions by an open-enrollment charter
88 school to the Teacher Retirement System of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 825.405, Government Code, is amended by
1111 adding Subsection (a-1) and amending Subsections (b), (e), and (f)
1212 to read as follows:
1313 (a-1) For members who are employed by an open-enrollment
1414 charter school and who would be entitled to a minimum salary under
1515 Section 21.402, Education Code, if employed by a school district,
1616 the charter school shall pay the state's contribution on the
1717 portion of the member's salary that exceeds the applicable
1818 statutory minimum salary under that section.
1919 (b) For purposes of Subsection (a) [this section]:
2020 (1) the statutory minimum salary for certain school
2121 personnel under Section 21.402, Education Code, is the salary
2222 provided by that section multiplied by the cost of education
2323 adjustment applicable under Section 42.102, Education Code, to the
2424 district in which the member is employed; and
2525 (2) the statutory minimum salary for members who would
2626 have been entitled to the minimum salary for certain school
2727 personnel under former Section 16.056, Education Code, as that
2828 section existed on January 1, 1995, is a minimum salary computed in
2929 the same manner as the minimum salary for certain school personnel
3030 under Section 21.402, Education Code, multiplied by the cost of
3131 education adjustment applicable under Section 42.102, Education
3232 Code, to the district in which the member is employed.
3333 (e) After the end of each school year, the retirement system
3434 shall certify to the commissioner of education:
3535 (1) the names of any employers [employing districts]
3636 that have failed to remit, within the period required by Section
3737 825.408, all contributions required under this section for the
3838 school year; and
3939 (2) the amounts of the unpaid contributions.
4040 (f) If the commissioner of education receives a
4141 certification under Subsection (e), the commissioner shall direct
4242 the comptroller of public accounts to withhold the amount
4343 certified, plus interest computed at the rate and in the manner
4444 provided by Section 825.408, from the first state money payable to
4545 the employer [school district]. The amount withheld shall be
4646 deposited to the credit of the appropriate accounts of the
4747 retirement system.
4848 SECTION 2. This Act applies beginning with the 2019-2020
4949 school year.
5050 SECTION 3. This Act takes effect September 1, 2019.
