7 | 7 | | relating to certain contributions by an open-enrollment charter |

8 | 8 | | school to the Teacher Retirement System of Texas. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 825.405, Government Code, is amended by |
---|
11 | 11 | | adding Subsection (a-1) and amending Subsections (b), (e), and (f) |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (a-1) For members who are employed by an open-enrollment |
---|
14 | 14 | | charter school and who would be entitled to a minimum salary under |
---|
15 | 15 | | Section 21.402, Education Code, if employed by a school district, |
---|
16 | 16 | | the charter school shall pay the state's contribution on the |
---|
17 | 17 | | portion of the member's salary that exceeds the applicable |
---|
18 | 18 | | statutory minimum salary under that section. |
---|
19 | 19 | | (b) For purposes of Subsection (a) [this section]: |
---|
20 | 20 | | (1) the statutory minimum salary for certain school |
---|
21 | 21 | | personnel under Section 21.402, Education Code, is the salary |
---|
22 | 22 | | provided by that section multiplied by the cost of education |
---|
23 | 23 | | adjustment applicable under Section 42.102, Education Code, to the |
---|
24 | 24 | | district in which the member is employed; and |
---|
25 | 25 | | (2) the statutory minimum salary for members who would |
---|
26 | 26 | | have been entitled to the minimum salary for certain school |
---|
27 | 27 | | personnel under former Section 16.056, Education Code, as that |
---|
28 | 28 | | section existed on January 1, 1995, is a minimum salary computed in |
---|
29 | 29 | | the same manner as the minimum salary for certain school personnel |
---|
30 | 30 | | under Section 21.402, Education Code, multiplied by the cost of |
---|
31 | 31 | | education adjustment applicable under Section 42.102, Education |
---|
32 | 32 | | Code, to the district in which the member is employed. |
---|
33 | 33 | | (e) After the end of each school year, the retirement system |
---|
34 | 34 | | shall certify to the commissioner of education: |
---|
35 | 35 | | (1) the names of any employers [employing districts] |
---|
36 | 36 | | that have failed to remit, within the period required by Section |
---|
37 | 37 | | 825.408, all contributions required under this section for the |
---|
38 | 38 | | school year; and |
---|
39 | 39 | | (2) the amounts of the unpaid contributions. |
---|
40 | 40 | | (f) If the commissioner of education receives a |
---|
41 | 41 | | certification under Subsection (e), the commissioner shall direct |
---|
42 | 42 | | the comptroller of public accounts to withhold the amount |
---|
43 | 43 | | certified, plus interest computed at the rate and in the manner |
---|
44 | 44 | | provided by Section 825.408, from the first state money payable to |
---|
45 | 45 | | the employer [school district]. The amount withheld shall be |
---|
46 | 46 | | deposited to the credit of the appropriate accounts of the |
---|
47 | 47 | | retirement system. |
---|
48 | 48 | | SECTION 2. This Act applies beginning with the 2019-2020 |
---|
49 | 49 | | school year. |
---|
50 | 50 | | SECTION 3. This Act takes effect September 1, 2019. |
