| 13 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 14 | 12 | SECTION 1. Section 71.153(a), Agriculture Code, is amended | |
| 15 | 13 | to read as follows: | |
| 16 | 14 | (a) A political subdivision may not adopt an ordinance or | |
| 17 | 15 | rule that: | |
| 18 | 16 | (1) restricts the planting, sale, or distribution of | |
| 19 | 17 | noxious or invasive plant species; or | |
| 20 | 18 | (2) prohibits or limits the removal by a landowner of a | |
| 21 | 19 | noxious or invasive plant species located on the landowner's | |
| 22 | - | property if the property is: | |
| 23 | - | (A) a homestead; | |
| 24 | - | (B) designated for agricultural use under | |
| 25 | - | Chapter 23, Tax Code; or | |
| 26 | - | (C) a single family residential property. | |

| 28 | 22 | amended by adding Section 203.0555 to read as follows: | |
| 29 | 23 | Sec. 203.0555. LOCAL REGULATION OF NOXIOUS BRUSH. (a) In | |
| 30 | 24 | this section, "noxious brush" means brush designated by the board | |
| 31 | 25 | as an eligible brush species detrimental to water conservation for | |
| 32 | 26 | purposes of implementing the state water supply enhancement plan. | |
| 33 | 27 | (b) Notwithstanding any other law, a municipality or county | |
| 34 | 28 | may not adopt or enforce an ordinance, order, rule, or other | |
| 35 | 29 | regulation that prohibits or limits the removal by a landowner of | |
| 36 | - | any noxious brush located on the landowner's property if the | |
| 37 | - | property is: | |
| 38 | - | (A) a homestead; | |
| 39 | - | (B) designated for agricultural use under | |
