86 AN ACT
97 relating to the authority of a political subdivision to regulate
108 the removal by a landowner of noxious or invasive plant species or
119 brush species detrimental to water conservation from the
1210 landowner's property.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Section 71.153(a), Agriculture Code, is amended
1513 to read as follows:
1614 (a) A political subdivision may not adopt an ordinance or
1715 rule that:
1816 (1) restricts the planting, sale, or distribution of
1917 noxious or invasive plant species; or
2018 (2) prohibits or limits the removal by a landowner of a
2119 noxious or invasive plant species located on the landowner's
22- property if the property is:
23- (A) a homestead;
24- (B) designated for agricultural use under
25- Chapter 23, Tax Code; or
26- (C) a single family residential property.

2721 SECTION 2. Subchapter C, Chapter 203, Agriculture Code, is
2822 amended by adding Section 203.0555 to read as follows:
2923 Sec. 203.0555. LOCAL REGULATION OF NOXIOUS BRUSH. (a) In
3024 this section, "noxious brush" means brush designated by the board
3125 as an eligible brush species detrimental to water conservation for
3226 purposes of implementing the state water supply enhancement plan.
3327 (b) Notwithstanding any other law, a municipality or county
3428 may not adopt or enforce an ordinance, order, rule, or other
3529 regulation that prohibits or limits the removal by a landowner of
36- any noxious brush located on the landowner's property if the
37- property is:
38- (A) a homestead;
39- (B) designated for agricultural use under
40- Chapter 23, Tax Code; or
41- (C) a single family residential property.
30+ any noxious brush located on the landowner's property.
4231 SECTION 3. This Act takes effect September 1, 2019.
