55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the offense of money laundering.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 34.01(2), Penal Code, is amended to read
1010 as follows:
1111 (2) "Funds" includes:
1212 (A) coin or paper money of the United States or
1313 any other country that is designated as legal tender and that
1414 circulates and is customarily used and accepted as a medium of
1515 exchange in the country of issue;
1616 (B) United States silver certificates, United
1717 States Treasury notes, and Federal Reserve System notes;
1818 (C) an official foreign bank note that is
1919 customarily used and accepted as a medium of exchange in a foreign
2020 country and a foreign bank draft; and
2121 (D) currency or its equivalent, including an
2222 electronic fund, a personal check, a bank check, a traveler's
2323 check, a money order, a bearer negotiable instrument, a bearer
2424 investment security, a bearer security, a certificate of stock in a
2525 form that allows title to pass on delivery, [or] a stored value card
2626 as defined by Section 604.001, Business & Commerce Code, or a
2727 digital currency.
2828 SECTION 2. The change in law made by this Act applies only
2929 to an offense committed on or after the effective date of this Act.
3030 An offense committed before the effective date of this Act is
3131 governed by the law in effect on the date the offense was committed,
3232 and the former law is continued in effect for that purpose. For
3333 purposes of this section, an offense was committed before the
3434 effective date of this Act if any element of the offense occurred
3535 before that date.
3636 SECTION 3. This Act takes effect September 1, 2019.
