8 | 8 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Article VII, Texas Constitution, is amended by | |
10 | 10 | adding Section 7 to read as follows: | |
11 | 11 | Sec. 7. (a) In this section, "private school" means a | |
12 | 12 | nongovernmental educational establishment that exists for the | |
13 | 13 | general education of elementary or secondary students. | |
14 | 14 | (b) The legislature may not appropriate money for or | |
15 | 15 | authorize a voucher program under which state or local public | |
16 | 16 | revenue is used to pay all or any part of the costs of a student's | |
17 | 17 | attendance at a private school. | |
18 | 18 | (c) This section does not prohibit the use of state or local | |
19 | 19 | public revenue to pay all or any part of the costs of attendance at a | |
20 | 20 | private school by a student with a disability if the student is | |
21 | 21 | entitled under federal law to receive special education services in | |
22 | 22 | that manner at no cost to the student. | |
23 | 23 | SECTION 2. This proposed constitutional amendment shall be | |
24 | 24 | submitted to the voters at an election to be held November 5, 2019. | |
25 | 25 | The ballot shall be printed to permit voting for or against the | |
26 | 26 | proposition: "The constitutional amendment prohibiting the | |
27 | 27 | authorization or funding of a voucher program for elementary or | |
28 | 28 | secondary education." |
