55 A JOINT RESOLUTION
66 proposing a constitutional amendment prohibiting the authorization
77 or funding of an elementary or secondary education voucher program.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article VII, Texas Constitution, is amended by
1010 adding Section 7 to read as follows:
1111 Sec. 7. (a) In this section, "private school" means a
1212 nongovernmental educational establishment that exists for the
1313 general education of elementary or secondary students.
1414 (b) The legislature may not appropriate money for or
1515 authorize a voucher program under which state or local public
1616 revenue is used to pay all or any part of the costs of a student's
1717 attendance at a private school.
1818 (c) This section does not prohibit the use of state or local
1919 public revenue to pay all or any part of the costs of attendance at a
2020 private school by a student with a disability if the student is
2121 entitled under federal law to receive special education services in
2222 that manner at no cost to the student.
2323 SECTION 2. This proposed constitutional amendment shall be
2424 submitted to the voters at an election to be held November 5, 2019.
2525 The ballot shall be printed to permit voting for or against the
2626 proposition: "The constitutional amendment prohibiting the
2727 authorization or funding of a voucher program for elementary or
2828 secondary education."
