7 | 7 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Article III, Texas Constitution, is amended by | |
9 | 9 | adding Section 48 to read as follows: | |
10 | 10 | Sec. 48. REGULATION OF CANNABIS. (a) | |
11 | 11 | In this section, | |
12 | 12 | "cannabis" means the plant Cannabis sativa L., whether growing or | |
13 | 13 | not, the seeds of that plant, and every compound, manufacture, | |
14 | 14 | salt, derivative, mixture, or preparation of that plant or its | |
15 | 15 | seeds. | |
16 | 16 | (b) The legislature by law shall authorize and regulate the | |
17 | 17 | possession, cultivation, and sale of cannabis in this state. | |
18 | 18 | SECTION 2. This proposed constitutional amendment shall be | |
19 | 19 | submitted to the voters at an election to be held November 3, 2020. | |
20 | 20 | The ballot shall be printed to provide for voting for or against the | |
21 | 21 | proposition: "The constitutional amendment directing the | |
22 | 22 | legislature to authorize and regulate the possession, cultivation, | |
23 | 23 | and sale of cannabis." |
