55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing Webb County to
77 delegate its authority to manage and dispose of county school land
88 and invest and manage the proceeds from the county permanent school
99 fund.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 6, Article VII, Texas Constitution, is
1212 amended to read as follows:
1313 Sec. 6. (a) All lands heretofore, or hereafter granted to
1414 the several counties of this State for educational purposes, are of
1515 right the property of said counties respectively, to which they
1616 were granted, and title thereto is vested in said counties, and no
1717 adverse possession or limitation shall ever be available against
1818 the title of any county. Each county may sell or dispose of its
1919 lands in whole or in part, in manner to be provided by the
2020 Commissioners Court of the county. Said lands, and, except as
2121 provided by Subsection (b) of this section, the proceeds thereof,
2222 when sold, shall be held by said counties alone as a trust for the
2323 benefit of public schools therein; said proceeds to be invested in
2424 bonds of the United States, the State of Texas, or counties in said
2525 State, or in such other securities, and under such restrictions as
2626 may be prescribed by law; and the counties shall be responsible for
2727 all investments; the interest thereon, and other revenue, except
2828 the principal shall be available fund.
2929 (b) Webb County may enter into an agreement with the school
3030 districts for which Webb County holds lands in trust under this
3131 section under which Webb County delegates to a committee whose
3232 membership consists of members of the boards of trustees of the
3333 school districts to:
3434 (1) sell, lease, manage, or otherwise dispose of the
3535 lands held in trust;
3636 (2) develop or sell the rights to natural resources or
3737 minerals in the lands held in trust; and
3838 (3) invest and manage all or part of the proceeds of
3939 Webb County's permanent school fund.
4040 (c) The proceeds from a disposition of land authorized under
4141 Subsection (b) of this section shall be held by Webb County as a
4242 trust for the benefit of the school districts as provided by
4343 Subsection (a) of this section.
4444 (d) The committee described in Subsection (b) of this
4545 section shall consist of one trustee appointed by each of the school
4646 districts for which the lands are held in trust by Webb County under
4747 this section.
4848 SECTION 2. This proposed constitutional amendment shall be
4949 submitted to the voters at an election to be held November 5, 2019.
5050 The ballot shall be printed to permit voting for or against the
5151 proposition: "The constitutional amendment to authorize Webb
5252 County to enter into an agreement to delegate its authority
5353 regarding the management and disposition of county school lands
5454 from Webb County to the school districts for which the lands are
5555 held in trust and to delegate its authority to invest and manage
5656 proceeds of Webb County's permanent school fund from Webb County to
5757 the school districts for which the lands are held in trust."
