| 7 | 7 | | delegate its authority to manage and dispose of county school land |

| 8 | 8 | | and invest and manage the proceeds from the county permanent school |
|---|
| 9 | 9 | | fund. |

| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 6, Article VII, Texas Constitution, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 6. (a) All lands heretofore, or hereafter granted to |
|---|
| 14 | 14 | | the several counties of this State for educational purposes, are of |
|---|
| 15 | 15 | | right the property of said counties respectively, to which they |
|---|
| 16 | 16 | | were granted, and title thereto is vested in said counties, and no |
|---|
| 17 | 17 | | adverse possession or limitation shall ever be available against |
|---|
| 18 | 18 | | the title of any county. Each county may sell or dispose of its |
|---|
| 19 | 19 | | lands in whole or in part, in manner to be provided by the |
|---|
| 20 | 20 | | Commissioners Court of the county. Said lands, and, except as |
|---|
| 21 | 21 | | provided by Subsection (b) of this section, the proceeds thereof, |
|---|
| 22 | 22 | | when sold, shall be held by said counties alone as a trust for the |
|---|
| 23 | 23 | | benefit of public schools therein; said proceeds to be invested in |
|---|
| 24 | 24 | | bonds of the United States, the State of Texas, or counties in said |
|---|
| 25 | 25 | | State, or in such other securities, and under such restrictions as |
|---|
| 26 | 26 | | may be prescribed by law; and the counties shall be responsible for |
|---|
| 27 | 27 | | all investments; the interest thereon, and other revenue, except |
|---|
| 28 | 28 | | the principal shall be available fund. |
|---|
| 29 | 29 | | (b) Webb County may enter into an agreement with the school |
|---|
| 30 | 30 | | districts for which Webb County holds lands in trust under this |
|---|
| 31 | 31 | | section under which Webb County delegates to a committee whose |
|---|
| 32 | 32 | | membership consists of members of the boards of trustees of the |
|---|
| 33 | 33 | | school districts to: |
|---|
| 34 | 34 | | (1) sell, lease, manage, or otherwise dispose of the |
|---|
| 35 | 35 | | lands held in trust; |
|---|
| 36 | 36 | | (2) develop or sell the rights to natural resources or |
|---|
| 37 | 37 | | minerals in the lands held in trust; and |
|---|
| 38 | 38 | | (3) invest and manage all or part of the proceeds of |
|---|
| 39 | 39 | | Webb County's permanent school fund. |
|---|
| 40 | 40 | | (c) The proceeds from a disposition of land authorized under |
|---|
| 41 | 41 | | Subsection (b) of this section shall be held by Webb County as a |
|---|
| 42 | 42 | | trust for the benefit of the school districts as provided by |
|---|
| 43 | 43 | | Subsection (a) of this section. |
|---|
| 44 | 44 | | (d) The committee described in Subsection (b) of this |
|---|
| 45 | 45 | | section shall consist of one trustee appointed by each of the school |
|---|
| 46 | 46 | | districts for which the lands are held in trust by Webb County under |
|---|
| 47 | 47 | | this section. |
|---|
| 48 | 48 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 49 | 49 | | submitted to the voters at an election to be held November 5, 2019. |
|---|
| 50 | 50 | | The ballot shall be printed to permit voting for or against the |
|---|
| 51 | 51 | | proposition: "The constitutional amendment to authorize Webb |
|---|
| 52 | 52 | | County to enter into an agreement to delegate its authority |
|---|
| 53 | 53 | | regarding the management and disposition of county school lands |
|---|
| 54 | 54 | | from Webb County to the school districts for which the lands are |
|---|
| 55 | 55 | | held in trust and to delegate its authority to invest and manage |
|---|
| 56 | 56 | | proceeds of Webb County's permanent school fund from Webb County to |
|---|
| 57 | 57 | | the school districts for which the lands are held in trust." |
