| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 49-g(c-2), Article III, Texas |
|---|
| 12 | 12 | | Constitution, is amended to read as follows: |
|---|
| 13 | 13 | | (c-2) The legislature by general law shall provide for a |
|---|
| 14 | 14 | | procedure by which the allocation of the sum of the amounts |
|---|
| 15 | 15 | | described by Subsections (d) and (e) of this section may be adjusted |
|---|
| 16 | 16 | | to provide for a transfer to the economic stabilization fund of an |
|---|
| 17 | 17 | | amount greater than the allocation provided for under Subsection |
|---|
| 18 | 18 | | (c-1) of this section with the remainder of that sum, if any, |
|---|
| 19 | 19 | | allocated for transfer to the state highway fund. The legislature |
|---|
| 20 | 20 | | by general law may provide for all or any portion of the amount that |
|---|
| 21 | 21 | | is allocated for transfer to the economic stabilization fund under |
|---|
| 22 | 22 | | Subsection (c-1) or this subsection instead to be allocated and |
|---|
| 23 | 23 | | made available for appropriation only for purposes related to |
|---|
| 24 | 24 | | public primary or secondary education. An [The] allocation made as |
|---|
| 25 | 25 | | provided by [that] general law enacted under the authority of this |
|---|
| 26 | 26 | | subsection is binding on the comptroller for the purposes of the |
|---|
| 27 | 27 | | transfers required by Subsection (c) of this section. |
|---|
| 28 | 28 | | SECTION 2. The following temporary provision is added to |
|---|
| 29 | 29 | | the Texas Constitution: |
|---|
| 30 | 30 | | TEMPORARY PROVISION. (a) This temporary provision applies |
|---|
| 31 | 31 | | to the constitutional amendment proposed by the 86th Legislature, |
|---|
| 32 | 32 | | Regular Session, 2019, authorizing the legislature to provide for |
|---|
| 33 | 33 | | certain revenues otherwise allocated for transfer to the economic |
|---|
| 34 | 34 | | stabilization fund to be used for purposes related to public |
|---|
| 35 | 35 | | primary and secondary education. |
|---|
| 36 | 36 | | (b) The amendments to Section 49-g, Article III, of this |
|---|
| 37 | 37 | | constitution take effect January 1, 2020. |
|---|
| 38 | 38 | | (c) This temporary provision expires January 1, 2021. |
|---|
| 39 | 39 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 40 | 40 | | submitted to the voters at an election to be held November 5, 2019. |
|---|
| 41 | 41 | | The ballot shall be printed to permit voting for or against the |
|---|
| 42 | 42 | | proposition: "The constitutional amendment authorizing the |
|---|
| 43 | 43 | | legislature to provide for certain revenues otherwise allocated for |
|---|
| 44 | 44 | | transfer to the economic stabilization fund to be used for purposes |
|---|
| 45 | 45 | | related to public primary and secondary education." |
