55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the legislature
77 to provide for certain revenues otherwise allocated for transfer to
88 the economic stabilization fund to be used for purposes related to
99 public primary and secondary education.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 49-g(c-2), Article III, Texas
1212 Constitution, is amended to read as follows:
1313 (c-2) The legislature by general law shall provide for a
1414 procedure by which the allocation of the sum of the amounts
1515 described by Subsections (d) and (e) of this section may be adjusted
1616 to provide for a transfer to the economic stabilization fund of an
1717 amount greater than the allocation provided for under Subsection
1818 (c-1) of this section with the remainder of that sum, if any,
1919 allocated for transfer to the state highway fund. The legislature
2020 by general law may provide for all or any portion of the amount that
2121 is allocated for transfer to the economic stabilization fund under
2222 Subsection (c-1) or this subsection instead to be allocated and
2323 made available for appropriation only for purposes related to
2424 public primary or secondary education. An [The] allocation made as
2525 provided by [that] general law enacted under the authority of this
2626 subsection is binding on the comptroller for the purposes of the
2727 transfers required by Subsection (c) of this section.
2828 SECTION 2. The following temporary provision is added to
2929 the Texas Constitution:
3030 TEMPORARY PROVISION. (a) This temporary provision applies
3131 to the constitutional amendment proposed by the 86th Legislature,
3232 Regular Session, 2019, authorizing the legislature to provide for
3333 certain revenues otherwise allocated for transfer to the economic
3434 stabilization fund to be used for purposes related to public
3535 primary and secondary education.
3636 (b) The amendments to Section 49-g, Article III, of this
3737 constitution take effect January 1, 2020.
3838 (c) This temporary provision expires January 1, 2021.
3939 SECTION 3. This proposed constitutional amendment shall be
4040 submitted to the voters at an election to be held November 5, 2019.
4141 The ballot shall be printed to permit voting for or against the
4242 proposition: "The constitutional amendment authorizing the
4343 legislature to provide for certain revenues otherwise allocated for
4444 transfer to the economic stabilization fund to be used for purposes
4545 related to public primary and secondary education."
