---|
8 | 8 | | developmental disability. |

9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Article III, Texas Constitution, is amended by |
---|
11 | 11 | | adding Section 68 to read as follows: |
---|
12 | 12 | | Sec. 68. (a) The legislature by general law may authorize |
---|
13 | 13 | | the Texas Public Finance Authority or its successor in function to |
---|
14 | 14 | | provide for, issue, and sell general obligation bonds of the State |
---|
15 | 15 | | of Texas in an amount not to exceed $10 million for the purpose of |
---|
16 | 16 | | funding a program to create additional housing for individuals with |
---|
17 | 17 | | an intellectual or developmental disability. |
---|
18 | 18 | | (b) Proceeds from the sale of the bonds shall be deposited |
---|
19 | 19 | | in separate funds or accounts, as provided by general law, in the |
---|
20 | 20 | | state treasury to be used by the Health and Human Services |
---|
21 | 21 | | Commission or its successor in function to conduct the program |
---|
22 | 22 | | described by this section. |
---|
23 | 23 | | (c) The bond proceeds may be used to pay the costs of issuing |
---|
24 | 24 | | the bonds and any administrative expense related to the bonds. |
---|
25 | 25 | | (d) While any of the bonds or interest on the bonds |
---|
26 | 26 | | authorized by this section is outstanding and unpaid, from the |
---|
27 | 27 | | first money coming into the state treasury in each fiscal year not |
---|
28 | 28 | | otherwise appropriated by this constitution, an amount sufficient |
---|
29 | 29 | | to pay the principal of and interest on bonds that mature or become |
---|
30 | 30 | | due during the fiscal year and to make payments that become due |
---|
31 | 31 | | under a related credit agreement during the fiscal year is |
---|
32 | 32 | | appropriated, less the amount in the sinking fund at the close of |
---|
33 | 33 | | the previous fiscal year. |
---|
34 | 34 | | (e) Bonds issued under this section, after approval by the |
---|
35 | 35 | | attorney general, registration by the comptroller of public |
---|
36 | 36 | | accounts, and delivery to the purchasers, are incontestable and are |
---|
37 | 37 | | general obligations of the State of Texas under this constitution. |
---|
38 | 38 | | (f) The Texas Public Finance Authority shall consider using |
---|
39 | 39 | | a business whose principal place of business is located in this |
---|
40 | 40 | | state to issue the bonds authorized by this section and shall |
---|
41 | 41 | | include using a historically underutilized business as defined by |
---|
42 | 42 | | general law. |
---|
43 | 43 | | SECTION 2. This proposed constitutional amendment shall be |
---|
44 | 44 | | submitted to the voters at an election to be held November 5, 2019. |
---|
45 | 45 | | The ballot shall be printed to permit voting for or against the |
---|
46 | 46 | | proposition: "The constitutional amendment authorizing the |
---|
47 | 47 | | issuance of general obligation bonds for conducting a program to |
---|
48 | 48 | | create additional housing for individuals with an intellectual or |
---|
49 | 49 | | developmental disability." |
