44 A JOINT RESOLUTION
55 proposing a constitutional amendment authorizing the issuance of
66 general obligation bonds for conducting a program to create
77 additional housing for individuals with an intellectual or
88 developmental disability.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article III, Texas Constitution, is amended by
1111 adding Section 68 to read as follows:
1212 Sec. 68. (a) The legislature by general law may authorize
1313 the Texas Public Finance Authority or its successor in function to
1414 provide for, issue, and sell general obligation bonds of the State
1515 of Texas in an amount not to exceed $10 million for the purpose of
1616 funding a program to create additional housing for individuals with
1717 an intellectual or developmental disability.
1818 (b) Proceeds from the sale of the bonds shall be deposited
1919 in separate funds or accounts, as provided by general law, in the
2020 state treasury to be used by the Health and Human Services
2121 Commission or its successor in function to conduct the program
2222 described by this section.
2323 (c) The bond proceeds may be used to pay the costs of issuing
2424 the bonds and any administrative expense related to the bonds.
2525 (d) While any of the bonds or interest on the bonds
2626 authorized by this section is outstanding and unpaid, from the
2727 first money coming into the state treasury in each fiscal year not
2828 otherwise appropriated by this constitution, an amount sufficient
2929 to pay the principal of and interest on bonds that mature or become
3030 due during the fiscal year and to make payments that become due
3131 under a related credit agreement during the fiscal year is
3232 appropriated, less the amount in the sinking fund at the close of
3333 the previous fiscal year.
3434 (e) Bonds issued under this section, after approval by the
3535 attorney general, registration by the comptroller of public
3636 accounts, and delivery to the purchasers, are incontestable and are
3737 general obligations of the State of Texas under this constitution.
3838 (f) The Texas Public Finance Authority shall consider using
3939 a business whose principal place of business is located in this
4040 state to issue the bonds authorized by this section and shall
4141 include using a historically underutilized business as defined by
4242 general law.
4343 SECTION 2. This proposed constitutional amendment shall be
4444 submitted to the voters at an election to be held November 5, 2019.
4545 The ballot shall be printed to permit voting for or against the
4646 proposition: "The constitutional amendment authorizing the
4747 issuance of general obligation bonds for conducting a program to
4848 create additional housing for individuals with an intellectual or
4949 developmental disability."
