88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 47, Article III, Texas Constitution, is
1010 amended by amending Subsection (a) and adding Subsection (f) to
1111 read as follows:
1212 (a) The Legislature shall pass laws prohibiting lotteries
1313 and gift enterprises in this State other than those authorized by
1414 Subsections (b), (d), (d-1), [and] (e), and (f) of this section.
1515 (f) The Legislature by law may authorize and regulate the
1616 operation of gaming devices commonly known as eight-liners or
1717 similar gaming devices. A law enacted under this subsection must
1818 allow the qualified voters of any county, justice precinct, or
1919 municipality to determine by a majority vote of the qualified
2020 voters voting on the question at an election whether eight-liners
2121 may be legally operated or prohibited in the county, justice
2222 precinct, or municipality. The Legislature may impose a fee on
2323 gaming devices approved by a majority of the voters or authorize a
2424 political subdivision to impose a fee on the devices. The
2525 Legislature may determine the rate of the fee and the allocation of
2626 the revenue from the fee notwithstanding any other provision of
2727 this Constitution governing the rate or allocation of occupations
2828 taxes.
2929 SECTION 2. This proposed constitutional amendment shall be
3030 submitted to the voters at an election to be held November 5, 2019.
3131 The ballot shall be printed to permit voting for or against the
3232 proposition: "The constitutional amendment authorizing local
3333 option elections to legalize or prohibit the operation of
3434 eight-liners."
