| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 47, Article III, Texas Constitution, is |
|---|
| 10 | 10 | | amended by amending Subsection (a) and adding Subsection (f) to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) The Legislature shall pass laws prohibiting lotteries |
|---|
| 13 | 13 | | and gift enterprises in this State other than those authorized by |
|---|
| 14 | 14 | | Subsections (b), (d), (d-1), [and] (e), and (f) of this section. |
|---|
| 15 | 15 | | (f) The Legislature by law may authorize and regulate the |
|---|
| 16 | 16 | | operation of gaming devices commonly known as eight-liners or |
|---|
| 17 | 17 | | similar gaming devices. A law enacted under this subsection must |
|---|
| 18 | 18 | | allow the qualified voters of any county, justice precinct, or |
|---|
| 19 | 19 | | municipality to determine by a majority vote of the qualified |
|---|
| 20 | 20 | | voters voting on the question at an election whether eight-liners |
|---|
| 21 | 21 | | may be legally operated or prohibited in the county, justice |
|---|
| 22 | 22 | | precinct, or municipality. The Legislature may impose a fee on |
|---|
| 23 | 23 | | gaming devices approved by a majority of the voters or authorize a |
|---|
| 24 | 24 | | political subdivision to impose a fee on the devices. The |
|---|
| 25 | 25 | | Legislature may determine the rate of the fee and the allocation of |
|---|
| 26 | 26 | | the revenue from the fee notwithstanding any other provision of |
|---|
| 27 | 27 | | this Constitution governing the rate or allocation of occupations |
|---|
| 28 | 28 | | taxes. |
|---|
| 29 | 29 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 30 | 30 | | submitted to the voters at an election to be held November 5, 2019. |
|---|
| 31 | 31 | | The ballot shall be printed to permit voting for or against the |
|---|
| 32 | 32 | | proposition: "The constitutional amendment authorizing local |
|---|
| 33 | 33 | | option elections to legalize or prohibit the operation of |
|---|
| 34 | 34 | | eight-liners." |
