55 A JOINT RESOLUTION
66 proposing a constitutional amendment requiring the state to expand
77 eligibility for Medicaid to certain persons under the federal
88 Patient Protection and Affordable Care Act.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article XVI, Texas Constitution, is amended by
1111 adding Section 74 to read as follows:
1212 Sec. 74. The state shall provide medical assistance under
1313 the federal Medicaid program to all persons who apply for that
1414 assistance and for whom federal matching funds are available under
1515 the Patient Protection and Affordable Care Act (Pub. L. No.
1616 111-148), as amended by the Health Care and Education
1717 Reconciliation Act of 2010 (Pub. L. No. 111-152), to the state to
1818 provide that assistance.
1919 SECTION 2. The following temporary provision is added to
2020 the Texas Constitution:
2121 TEMPORARY PROVISION. (a) This temporary provision applies
2222 to the constitutional amendment proposed by the 86th Legislature,
2323 Regular Session, 2019, requiring the state to expand eligibility
2424 for Medicaid to all persons for whom federal matching funds are
2525 available under the federal Patient Protection and Affordable Care
2626 Act.
2727 (b) Section 74, Article XVI, of this constitution takes
2828 effect January 1, 2020.
2929 (c) This temporary provision expires January 1, 2021.
3030 SECTION 3. This proposed constitutional amendment shall be
3131 submitted to the voters at an election to be held November 5, 2019.
3232 The ballot shall be printed to provide for voting for or against the
3333 proposition: "The constitutional amendment requiring the state to
3434 expand eligibility for Medicaid to all persons for whom federal
3535 matching funds are available under the federal Patient Protection
3636 and Affordable Care Act."
