| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article XVI, Texas Constitution, is amended by |
|---|
| 11 | 11 | | adding Section 74 to read as follows: |
|---|
| 12 | 12 | | Sec. 74. The state shall provide medical assistance under |
|---|
| 13 | 13 | | the federal Medicaid program to all persons who apply for that |
|---|
| 14 | 14 | | assistance and for whom federal matching funds are available under |
|---|
| 15 | 15 | | the Patient Protection and Affordable Care Act (Pub. L. No. |
|---|
| 16 | 16 | | 111-148), as amended by the Health Care and Education |
|---|
| 17 | 17 | | Reconciliation Act of 2010 (Pub. L. No. 111-152), to the state to |
|---|
| 18 | 18 | | provide that assistance. |
|---|
| 19 | 19 | | SECTION 2. The following temporary provision is added to |
|---|
| 20 | 20 | | the Texas Constitution: |
|---|
| 21 | 21 | | TEMPORARY PROVISION. (a) This temporary provision applies |
|---|
| 22 | 22 | | to the constitutional amendment proposed by the 86th Legislature, |
|---|
| 23 | 23 | | Regular Session, 2019, requiring the state to expand eligibility |
|---|
| 24 | 24 | | for Medicaid to all persons for whom federal matching funds are |
|---|
| 25 | 25 | | available under the federal Patient Protection and Affordable Care |
|---|
| 26 | 26 | | Act. |
|---|
| 27 | 27 | | (b) Section 74, Article XVI, of this constitution takes |
|---|
| 28 | 28 | | effect January 1, 2020. |
|---|
| 29 | 29 | | (c) This temporary provision expires January 1, 2021. |
|---|
| 30 | 30 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 31 | 31 | | submitted to the voters at an election to be held November 5, 2019. |
|---|
| 32 | 32 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 33 | 33 | | proposition: "The constitutional amendment requiring the state to |
|---|
| 34 | 34 | | expand eligibility for Medicaid to all persons for whom federal |
|---|
| 35 | 35 | | matching funds are available under the federal Patient Protection |
|---|
| 36 | 36 | | and Affordable Care Act." |
