55 A JOINT RESOLUTION
66 proposing a constitutional amendment to dedicate net revenue from
77 the state lottery to support educational programs that benefit
88 classroom teaching in the state's public schools and to prohibit
99 certain lottery advertisements and promotions.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 47, Article III, Texas Constitution, is
1212 amended by amending Subsection (e) and adding Subsection (f) to
1313 read as follows:
1414 (e) The Legislature by general law may authorize the State
1515 to operate lotteries and may authorize the State to enter into a
1616 contract with one or more legal entities that will operate
1717 lotteries on behalf of the State. All money received by the State
1818 from the operation of lotteries, other than amounts paid for
1919 administrative costs, lottery prizes, and unclaimed lottery
2020 prizes, is dedicated to and may be expended only for the enrichment
2121 of educational programs of the State's public primary and secondary
2222 schools and only for items that directly benefit classroom
2323 teaching, including teacher compensation and the acquisition of
2424 textbooks and educational supplies, materials, equipment, and
2525 services.
2626 (f) The State, a legal entity contracting with the State to
2727 operate lotteries authorized by Subsection (e) of this section, or
2828 a holder of a license issued by the State related to the operation
2929 of a lottery authorized by that subsection may not sponsor an
3030 advertisement or promotion that encourages or attempts to influence
3131 a person to purchase a lottery ticket by stating the revenue
3232 generated from the ticket sale will be used to support or provide
3333 additional money for the State's public primary or secondary
3434 schools.
3535 SECTION 2. This proposed constitutional amendment shall be
3636 submitted to the voters at an election to be held November 5, 2019.
3737 The ballot shall be printed to permit voting for or against the
3838 proposition: "The constitutional amendment to dedicate net revenue
3939 from the state lottery to support educational programs that benefit
4040 classroom teaching in the state's public schools and to prohibit
4141 advertisements and promotions that state the revenue generated by
4242 the sale of lottery tickets is used to financially assist public
4343 schools."
