55 A JOINT RESOLUTION
66 proposing a constitutional amendment providing for the creation of
77 the Texas resilience infrastructure fund to assist in the financing
88 of resilience projects.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article III, Texas Constitution, is amended by
1111 adding Section 49-d-14 to read as follows:
1212 Sec. 49-d-14. (a) The Texas resilience infrastructure
1313 fund is created as a special fund in the state treasury outside the
1414 general revenue fund.
1515 (b) As provided by general law, money in the Texas
1616 resilience infrastructure fund may be administered and used,
1717 without further appropriation, by the Texas Water Development Board
1818 or that board's successor in function to provide financing for
1919 projects to prevent flooding or mitigate damage from flooding
2020 related to a rainstorm, tropical storm or depression, hurricane, or
2121 storm surge affecting in this state or coastal public land:
2222 (1) public health or welfare;
2323 (2) public or private property; or
2424 (3) habitat for fish or wildlife.
2525 (c) Separate accounts may be established in the Texas
2626 resilience infrastructure fund as necessary to administer the fund
2727 or authorized projects.
2828 SECTION 2. This proposed constitutional amendment shall be
2929 submitted to the voters at an election to be held November 5, 2019.
3030 The ballot shall be printed to permit voting for or against the
3131 proposition: "The constitutional amendment providing for the
3232 creation of the Texas resilience infrastructure fund to assist in
3333 the financing of resilience projects."
