| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article III, Texas Constitution, is amended by |
|---|
| 11 | 11 | | adding Section 49-d-14 to read as follows: |
|---|
| 12 | 12 | | Sec. 49-d-14. (a) The Texas resilience infrastructure |
|---|
| 13 | 13 | | fund is created as a special fund in the state treasury outside the |
|---|
| 14 | 14 | | general revenue fund. |
|---|
| 15 | 15 | | (b) As provided by general law, money in the Texas |
|---|
| 16 | 16 | | resilience infrastructure fund may be administered and used, |
|---|
| 17 | 17 | | without further appropriation, by the Texas Water Development Board |
|---|
| 18 | 18 | | or that board's successor in function to provide financing for |
|---|
| 19 | 19 | | projects to prevent flooding or mitigate damage from flooding |
|---|
| 20 | 20 | | related to a rainstorm, tropical storm or depression, hurricane, or |
|---|
| 21 | 21 | | storm surge affecting in this state or coastal public land: |
|---|
| 22 | 22 | | (1) public health or welfare; |
|---|
| 23 | 23 | | (2) public or private property; or |
|---|
| 24 | 24 | | (3) habitat for fish or wildlife. |
|---|
| 25 | 25 | | (c) Separate accounts may be established in the Texas |
|---|
| 26 | 26 | | resilience infrastructure fund as necessary to administer the fund |
|---|
| 27 | 27 | | or authorized projects. |
|---|
| 28 | 28 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 29 | 29 | | submitted to the voters at an election to be held November 5, 2019. |
|---|
| 30 | 30 | | The ballot shall be printed to permit voting for or against the |
|---|
| 31 | 31 | | proposition: "The constitutional amendment providing for the |
|---|
| 32 | 32 | | creation of the Texas resilience infrastructure fund to assist in |
|---|
| 33 | 33 | | the financing of resilience projects." |
