86 proposing a constitutional amendment authorizing the state or a
97 municipality or county to donate certain property to the United
108 States to promote border crossing security or international bridge
119 trade corridors, to issue public securities to finance the
1210 acquisition or construction of that property, and to use public
1311 money to make certain payments related to public-private
1412 partnerships.
1513 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1614 SECTION 1. Article III, Texas Constitution, is amended by
17- adding Section 52m to read as follows:
15+ adding Sections 52m and 52n to read as follows:
1816 Sec. 52m. (a) The state or a municipality or county may
1917 unconditionally donate to the United States to promote border
2018 crossing security or international bridge trade corridors:
2119 (1) real property acquired by and improvements to that
2220 property acquired or constructed by the state or the municipality
2321 or county; and
2422 (2) technology or equipment acquired by the state or
2523 the municipality or county.
2624 (b) For the purposes described by Subsection (a) of this
2725 section, the state or a municipality or county may issue public
28- securities as provided under general law for financing public
29- works, without the necessity of further or amendatory legislation,
26+ securities as provided under general law for financing public works
3027 to:
3128 (1) finance the acquisition of property described by
3229 that subsection or the construction of improvements described by
3330 that subsection; or
3431 (2) refund or refinance existing debt incurred by the
3532 state or the municipality or county to acquire property described
3633 by that subsection or to construct improvements described by that
3734 subsection.
38- (c) An election is not required to authorize a public
39- security issued under Subsection (b) of this section regardless of
40- whether the public security is payable from ad valorem taxes.
41- (d) The state or a municipality or county may use public
42- money to pay lease payments, service payments, user fees, debt
43- service, or other costs associated with a public-private
44- partnership to establish public works for border crossing security
45- or for international bridge trade corridors.
35+ Sec. 52n. The state or a municipality or county may use
36+ public money to pay lease payments, service payments, user fees,
37+ debt service, or other costs associated with a public-private
38+ partnership.
4639 SECTION 2. This proposed constitutional amendment shall be
4740 submitted to the voters at an election to be held November 5, 2019.
4841 The ballot shall be printed to permit voting for or against the
4942 proposition: "The constitutional amendment authorizing the state
5043 or a municipality or county to unconditionally donate to the United
5144 States certain property acquired or constructed by the state or the
5245 municipality or county to promote border crossing security or
5346 international bridge trade corridors, to issue public securities to
5447 finance the acquisition or construction of that property, and to
5548 use public money to make certain payments related to public-private
56- partnerships establishing public works for those purposes."
