55 BE IT RESOLVED by the House of Representatives of the State of
66 Texas, 86th Legislature, Regular Session, 2019, That House Rule 13,
77 Section 9(a), be suspended in part as provided by House Rule 13,
88 Section 9(f), to enable the conference committee appointed to
99 resolve the differences on House Bill 2847 (the licensing and
1010 regulation of certain occupations, activities, and agreements;
1111 providing a civil penalty; authorizing fees; requiring an
1212 occupational registration and an occupational license) to consider
1313 and take action on the following matter:
1414 House Rule 13, Section 9(a)(4), is suspended to permit the
1515 committee to add text on a matter not included in either the house
1616 or senate version of the bill by adding SECTION 14.007 to the bill,
1717 adding Section 1603.208, Occupations Code, to read as follows:
1818 SECTION 14.007. Subchapter E, Chapter 1603, Occupations
1919 Code, is amended by adding Section 1603.208 to read as follows:
2020 Sec. 1603.208. DIGITALLY PREARRANGED REMOTE SERVICES.
2121 (a) In this section:
2222 (1) "Digital network" means any online-enabled
2323 application, Internet website, or system offered or used by a
2424 remote service business that allows a client to arrange for a
2525 digitally prearranged remote service.
2626 (2) "Digitally prearranged remote service" means a
2727 barbering or cosmetology service performed for compensation by a
2828 person holding a license, certificate of registration, or permit
2929 under Chapter 1601 or 1602 or this chapter that is:
3030 (A) prearranged through a digital network; and
3131 (B) performed at a location other than a place of
3232 business that is licensed or permitted under Chapter 1601 or 1602 or
3333 this chapter.
3434 (3) "Remote service business" means a corporation,
3535 partnership, sole proprietorship, or other entity that, for
3636 compensation, enables a client to schedule a digitally prearranged
3737 remote service with a person holding a license, certificate of
3838 registration, or permit under Chapter 1601 or 1602 or this chapter.
3939 (b) The commission shall adopt rules to administer this
4040 section, including rules that:
4141 (1) set minimum standards for:
4242 (A) the operation of a remote service business;
4343 and
4444 (B) the sanitation requirements for performing a
4545 digitally prearranged remote service;
4646 (2) determine activities within the scope of barbering
4747 and cosmetology that may be performed as a digitally prearranged
4848 remote service; and
4949 (3) establish procedures for inspecting and auditing
5050 the records of a remote service business and of a person who
5151 performs a digitally prearranged remote service.
5252 (c) Sections 1601.453, 1601.455, 1602.251(c), and 1602.407
5353 do not apply to a digitally prearranged remote service scheduled
5454 through a remote service business.
5555 (d) A person who holds a license, certificate of
5656 registration, or permit to practice barbering or cosmetology and
5757 who performs a digitally prearranged remote service shall:
5858 (1) comply with this section and the rules adopted
5959 under this section; and
6060 (2) practice within the scope of the person's license,
6161 certificate of registration, or permit.
6262 (e) A remote service business may not offer a barbering or
6363 cosmetology service that requires treating or removing a person's
6464 hair by:
6565 (1) coloring;
6666 (2) processing;
6767 (3) bleaching;
6868 (4) dyeing;
6969 (5) tinting; or
7070 (6) using a cosmetic preparation.
7171 (f) Before a person licensed, registered, or permitted to
7272 practice barbering or cosmetology performs a digitally prearranged
7373 remote service for a client requesting the service, a remote
7474 service business shall provide through the entity's digital
7575 network:
7676 (1) the following information regarding the person who
7777 will perform the service:
7878 (A) the person's first and last name;
7979 (B) the number of the person's license,
8080 certificate of registration, or permit, as applicable; and
8181 (C) a photograph of the person;
8282 (2) the following information regarding the business:
8383 (A) Internet website address; and
8484 (B) telephone number; and
8585 (3) the department's Internet website address and
8686 telephone number and notice that the client may contact the
8787 department to file a complaint against the business or person.
8888 (g) Within a reasonable time after completion of a digitally
8989 prearranged remote service, the remote service business shall issue
9090 to the client who requested the service a receipt that includes:
9191 (1) the date the service was provided;
9292 (2) a description of the service;
9393 (3) the first and last name of the person who performed
9494 the service;
9595 (4) the number of the person's license, certificate of
9696 registration, or permit, as applicable;
9797 (5) the following information regarding the business:
9898 (A) Internet website address; and
9999 (B) telephone number; and
100100 (6) the department's Internet website address and
101101 telephone number and notice that the client may contact the
102102 department to file a complaint against the business or person.
103103 (h) A remote service business shall maintain each record
104104 showing compliance with this section and the rules adopted under
105105 this section until at least the fifth anniversary of the date the
106106 record was generated.
107107 (i) A remote service business shall terminate a person's
108108 access to the business's digital network if the business or
109109 department determines the person violated:
110110 (1) this chapter;
111111 (2) a rule adopted under this chapter;
112112 (3) Chapter 1601 or 1602; or
113113 (4) a rule adopted under Chapter 1601 or 1602.
114114 Explanation: The addition is necessary to regulate companies
115115 that prearrange barbering and cosmetology services outside of
116116 certain facilities.
