65 AN ACT
76 relating to the municipal regulation of housing for homeless
87 individuals provided by a religious organization.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Chapter 229, Local Government Code, is amended
1110 by adding Subchapter C to read as follows:
1211 SUBCHAPTER C. REGULATION OF HOUSING PROVIDED BY RELIGIOUS
1312 ORGANIZATIONS
1413 Sec. 229.071. DEFINITIONS. In this subchapter:
1514 (1) "Homeless individual" includes any individual in
1615 need of housing assistance.
1716 (2) "Religious organization" has the meaning assigned
1817 by Section 464.051, Health and Safety Code.
1918 Sec. 229.072. CERTAIN ZONING OR LAND USE REGULATIONS
2019 PROHIBITED. A municipal zoning or land use ordinance may not
2120 prohibit a religious organization from:
2221 (1) using the religious organization's facility as
2322 housing for homeless individuals; or
2423 (2) having housing units on the organization's
2524 property for homeless individuals.
2625 Sec. 229.073. OTHER REGULATIONS PERMITTED. (a) A
2726 municipality may adopt or enforce an ordinance that imposes
2827 reasonable health and safety regulations on housing for homeless
2928 individuals provided on a religious organization's property.
3029 (b) A municipality may require a religious organization
3130 that provides housing for homeless individuals on the
3231 organization's property to provide:
3332 (1) electricity and heat for each housing unit; and
3433 (2) at least one kitchen and bathroom on the property
3534 that may be used by the individuals.
3635 (c) For purposes of this section, "housing" does not include
3736 temporary housing provided during a life-threatening emergency or
3837 for natural disaster relief.
3938 SECTION 2. This Act takes effect September 1, 2019.
