115 A BILL TO BE ENTITLED
126 AN ACT
137 relating to the suspension of a student who is homeless from public
148 school.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Section 37.005, Education Code, is amended by
1711 adding Subsection (d) to read as follows:
18- (d) A school district or open-enrollment charter school may
19- not place a student who is homeless in out-of-school suspension
20- unless the student engages in conduct described by Subsections
21- (c)(1)-(3) while on school property or while attending a
22- school-sponsored or school-related activity on or off of school
23- property. The campus behavior coordinator may coordinate with the
24- school district's homeless education liaison to identify
25- appropriate alternatives to out-of-school suspension for a student
26- who is homeless. In this subsection, "student who is homeless" has
27- the meaning assigned to the term "homeless children and youths"
28- under 42 U.S.C. Section 11434a.
12+ (d) A student who is homeless may not be placed in
13+ out-of-school suspension. The campus behavior coordinator may
14+ coordinate with the school district's homeless education liaison to
15+ identify appropriate alternatives to out-of-school suspension for
16+ a student who is homeless. In this subsection, "student who is
17+ homeless" has the meaning assigned to the term "homeless children

2919 SECTION 2. This Act applies beginning with the 2019-2020
3020 school year.
3121 SECTION 3. This Act takes effect immediately if it receives
3222 a vote of two-thirds of all the members elected to each house, as
3323 provided by Section 39, Article III, Texas Constitution. If this
3424 Act does not receive the vote necessary for immediate effect, this
3525 Act takes effect September 1, 2019.
