55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the evaluation of and improvements to the quality of the
88 Texas Workforce Commission's subsidized child care program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 302.0042, Labor Code, is amended by
1111 amending Subsection (b) and adding Subsection (c) to read as
1212 follows:
1313 (b) The commission's evaluation must assess:
1414 (1) the use of current federal child care funds by each
1515 local workforce development board;
1616 (2) the ability of each local workforce development
1717 board to meet child care performance measures;
1818 (3) the estimated [average] cost incurred by child
1919 care providers [of child care] in each local workforce development
2020 area as stated in the report required under 45 C.F.R. Section
2121 98.45(f)(1);
2222 (4) the average price charged by child care providers
2323 for child care in each local workforce development area as stated in
2424 the market rate survey conducted under 45 C.F.R. Section 98.45(c);
2525 (5) the poverty rate of each local workforce
2626 development area compared to the state's poverty rate;
2727 (6) [(5)] the number of children on waiting lists for
2828 child care in each local workforce development area; [and]
2929 (7) [(6)] the number of places that are reserved for
3030 participants in the child care subsidy program out of the total
3131 number of children enrolled with a provider on a full-time basis
3232 categorized by age of the child for each provider [vacant slots
3333 available for child care placement] in each local workforce
3434 development area that is certified as a 2-star, 3-star, or 4-star
3535 provider in the Texas Rising Star Program or that does not
3636 participate in the Texas Rising Star Program;
3737 (8) the total number of child care providers
3838 participating in the Texas Rising Star Program in each local
3939 workforce development area and the number of 2-star, 3-star, and
4040 4-star rated child care providers in the local workforce
4141 development area;
4242 (9) the number of child care providers participating
4343 in the Texas Rising Star Program in each local workforce
4444 development area as a percentage of the total number of subsidized
4545 child care providers in the local workforce development area and
4646 the number of 2-star, 3-star, and 4-star rated child care providers
4747 in the local workforce development area as a percentage of the total
4848 number of subsidized child care providers in the local workforce
4949 development area;
5050 (10) the total number of children enrolled in
5151 subsidized child care providers participating in the Texas Rising
5252 Star Program in each local workforce development area and the
5353 number of subsidized children enrolled in 2-star, 3-star, and
5454 4-star rated child care providers in the local workforce
5555 development area; and
5656 (11) the number of subsidized children enrolled in
5757 child care providers participating in the Texas Rising Star Program
5858 in each local workforce development area as a percentage of the
5959 total number of subsidized children enrolled in child care
6060 providers in the local workforce development area and the number of
6161 subsidized children enrolled in 2-star, 3-star, and 4-star rated
6262 child care providers in the local workforce development area as a
6363 percentage of the total number of subsidized children enrolled in
6464 child care providers in the local workforce development area.
6565 (c) For the purposes of evaluation under this section, the
6666 commission shall annually update the information described by
6767 Subsections (b)(6)-(11).
6868 SECTION 2. Section 302.0043, Labor Code, is amended by
6969 adding Subsection (c-1) and amending Subsections (e) and (f) to
7070 read as follows:
7171 (c-1) The commission shall measure and evaluate the
7272 progress of the commission's child care program regarding:
7373 (1) coordination by the commission with the Texas
7474 Education Agency to assign a Public Education Information
7575 Management System (PEIMS) number to children younger than six years
7676 of age enrolled in the commission's child care program;
7777 (2) coordination with the Texas Education Agency,
7878 school districts, and open-enrollment charter schools on any
7979 prekindergarten quality improvement efforts;
8080 (3) efforts to increase coordination between
8181 participating providers in the commission's child care program,
8282 school districts, and open-enrollment charter schools;
8383 (4) facilitation of child care provider enrollment in
8484 the Texas Rising Star Program and progression of providers to the
8585 highest rating level in the program; and
8686 (5) development and implementation of rates and
8787 payments, as determined by local workforce development boards, to:
8888 (A) allow participating providers to provide
8989 high quality child care; and
9090 (B) ensure that the commission meets performance
9191 measures established by the legislature for the average number of
9292 children served by the commission's child care program per day.
9393 (e) The commission shall make the information collected by
9494 the commission and the commission's findings available to local
9595 workforce development boards, school districts, open-enrollment
9696 charter schools, and the public.
9797 (f) Not later than January 15 of each odd-numbered year, the
9898 commission shall report to the legislature regarding the
9999 commission's findings regarding the effectiveness of the
100100 commission's child care program. The report must:
101101 (1) include employment outcome information,
102102 disaggregated by local workforce development area, regarding
103103 parents receiving subsidized care under the program; [and]
104104 (2) identify multiyear trends in the information
105105 collected and analyzed by the commission under this section,
106106 including trends in the information for at least the five state
107107 fiscal years preceding the date of the report; and
108108 (3) include information described by Sections
109109 302.0042(b)(8)-(11).
110110 SECTION 3. Section 302.00435, Labor Code, is amended to
111111 read as follows:
112112 Sec. 302.00435. SUBSIDIZED CHILD CARE PROGRAM; INPUT
113113 POLICY. (a) The commission shall develop a policy for obtaining,
114114 through appropriate methods, input from interested parties
115115 regarding its subsidized child care program and for using that
116116 input in administering that program.
117117 (b) The policy developed under Subsection (a) must include
118118 methods for obtaining input from the Texas Education Agency, school
119119 districts, open-enrollment charter schools, subsidized child care
120120 providers, relevant businesses, and the public, regarding:
121121 (1) improving coordination between the subsidized
122122 child care program and prekindergarten programs; and
123123 (2) increasing the quality of and access to the
124124 subsidized child care program.
125125 SECTION 4. This Act takes effect September 1, 2019.
