66 AN ACT
77 relating to the locations at which a cottage food production
88 operation may sell products.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 437.001(2-b), Health and Safety Code, is
1111 amended to read as follows:
1212 (2-b) "Cottage food production operation" means an
1313 individual, operating out of the individual's home, who:
1414 (A) produces at the individual's home, subject to
1515 Section 437.0196:
1616 (i) a baked good that is not a potentially
1717 hazardous food, as defined by Section 437.0196;
1818 (ii) candy;
1919 (iii) coated and uncoated nuts;
2020 (iv) unroasted nut butters;
2121 (v) fruit butters;
2222 (vi) a canned jam or jelly;
2323 (vii) a fruit pie;
2424 (viii) dehydrated fruit or vegetables,
2525 including dried beans;
2626 (ix) popcorn and popcorn snacks;
2727 (x) cereal, including granola;
2828 (xi) dry mix;
2929 (xii) vinegar;
3030 (xiii) pickles;
3131 (xiv) mustard;
3232 (xv) roasted coffee or dry tea; or
3333 (xvi) a dried herb or dried herb mix;
3434 (B) has an annual gross income of $50,000 or less
3535 from the sale of food described by Paragraph (A);
3636 (C) sells the foods produced under Paragraph (A)
3737 only directly to consumers at the individual's home, a farmers'
3838 market, a farm stand, or a municipal, county, or for-profit or
3939 nonprofit fair, festival, or event; and
4040 (D) delivers products to the consumer at the
4141 point of sale or another location designated by the consumer.
4242 SECTION 2. This Act takes effect September 1, 2019.
