66 AN ACT
77 relating to the duty of a water supply system to provide certain
88 information to consumers regarding fluoride in drinking water.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 341, Health and Safety
1111 Code, is amended by adding Section 341.0335 to read as follows:
1212 Sec. 341.0335. FLUORIDATED WATER; DISCLOSURE OF CERTAIN
1313 INFORMATION. (a) Except as provided in Subsection (b), a water
1414 supply system that furnishes drinking water to which fluoride has
1515 been added shall disclose in a conspicuous place on the system's
1616 publicly accessible Internet website:
1717 (1) the amount of fluoride that occurs naturally in
1818 the drinking water furnished by the system to a customer;
1919 (2) the amount of fluoride added to the drinking water
2020 before distribution to a customer;
2121 (3) the combined amount of fluoride in the drinking
2222 water from the sources described by Subdivisions (1) and (2);
2323 (4) as applicable, the identity of:
2424 (A) the person who supplies the fluoride
2525 additive; and
2626 (B) the person with whom the system contracts to
2727 add fluoride to the drinking water; and
2828 (5) the annual cost of adding fluoride to the drinking
2929 water distributed by the system, including the cost of the fluoride
3030 additive, the labor for adding the fluoride, and any contracts
3131 related to the fluoride additive.
3232 (b) A water supply system that does not maintain an Internet
3333 website shall annually disclose the information required under
3434 Subsection (a) by including a copy of the information with a bill
3535 sent to the system's customers.
3636 SECTION 2. A water supply system shall disclose the
3737 information required by Section 341.0335, Health and Safety Code,
3838 as added by this Act, not later than January 1, 2020.
3939 SECTION 3. This Act takes effect September 1, 2019.
