5	10		AN ACT
6	11		relating to an independent school district holding elections on the
7		-	November uniform election date and to the ballot for certain
8		-	independent school district elections.

9	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	14		SECTION 1. Section 11.0581(a), Education Code, is amended
11	15		to read as follows:
12	16		(a) An election for trustees of an independent school
13	17		district shall be held on the November uniform election date [the
14	18		same date as:
15	19		[(1) the election for the members of the governing
16	20		body of a municipality located in the school district;
17	21		[(2) the general election for state and county
18	22		officers;
19	23		[(3) the election for the members of the governing
20	24		body of a hospital district, if the school district:
21	25		[(A) is wholly or partly located in a county with
22	26		a population of less than 40,000 that is adjacent to a county with a
23	27		population of more than three million; and
24	28		[(B) held its election for trustees jointly with
25	29		the election for the members of the governing body of the hospital
26	30		district before May 2007; or
27	31		[(4) the election for the members of the governing
28	32		board of a public junior college district in which the school
29	33		district is wholly or partly located].
30	34		SECTION 2. Section 41.012, Education Code, is amended to
31	35		read as follows:
32	36		Sec. 41.012. DATE OF ELECTIONS. An election under this
33	37		chapter for voter approval of an agreement entered by the board of
34	38		trustees shall be held on the November uniform election date [a
35	39		Tuesday or Saturday not more than 45 days after the date of the
36	40		agreement. Section 41.001, Election Code, does not apply to the
37	41		election].
38	42		SECTION 3. Section 41.253(b), Education Code, is amended to
39	43		read as follows:
40	44		(b) The transitional board of trustees shall divide the
41	45		consolidated district into nine single-member trustee districts in
42	46		accordance with the procedures provided by Section 11.052. The
43	47		transitional board shall order an election for the initial board of
44	48		trustees to be held on the first November [May] uniform election
45	49		date after the effective date of a consolidation order.
46	50		SECTION 4. Subchapter A, Chapter 41, Election Code, is
47	51		amended by adding Section 41.0051 to read as follows:
48	52		Sec. 41.0051. INDEPENDENT SCHOOL DISTRICT ELECTION TO ISSUE
49	53		BONDS. Notwithstanding any other law, an election for the issuance
50	54		of bonds by an independent school district shall be held on the
51	55		November uniform election date.
52	56		SECTION 5. Section 41.0052, Election Code, is amended by
53	57		adding Subsection (a-3) to read as follows:
54	58		(a-3) The governing body of an independent school district
55	59		that holds its general election for officers on a date other than
56	60		the November uniform election date shall, not later than December
57	61		31, 2019, change the date on which it holds its general election for
58	62		officers to the November uniform election date. This subsection
59	63		expires January 1, 2020.
60		-	SECTION 6. Subchapter D, Chapter 52, Election Code, is
61		-	amended by adding Section 52.096 to read as follows:
62		-	Sec. 52.096. INDEPENDENT SCHOOL DISTRICT OFFICES AND
63		-	PROPOSITIONS. Notwithstanding a conflicting provision of this
64		-	code, for an election at which an office of or proposition for an
65		-	independent school district appears on the ballot, an office of or
66		-	proposition for an independent school district must be placed on
67		-	the ballot before all other offices or propositions.
