77 relating to prohibited practices by an insurer that issues a
88 preferred provider benefit plan regarding communication of the
99 preferred provider status of freestanding emergency medical care
1010 facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 1301, Insurance Code, is
1313 amended by adding Section 1301.0059 to read as follows:
1414 Sec. 1301.0059. COMMUNICATION OF PREFERRED PROVIDER STATUS
1515 OF FREESTANDING EMERGENCY MEDICAL CARE FACILITIES. It is an unfair
1616 method of competition or an unfair or deceptive act or practice
1717 under Chapter 541 for an insurer to prevent, by contract or
1818 otherwise, a freestanding emergency medical care facility that is a
1919 preferred provider from communicating with the public that the
2020 facility is in the insurer's preferred provider network.
2121 SECTION 2. This Act takes effect September 1, 2019.
