11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 1301, Insurance Code, is | |
13 | 13 | amended by adding Section 1301.0059 to read as follows: | |
14 | 14 | Sec. 1301.0059. COMMUNICATION OF PREFERRED PROVIDER STATUS | |
15 | 15 | OF FREESTANDING EMERGENCY MEDICAL CARE FACILITIES. It is an unfair | |
16 | 16 | method of competition or an unfair or deceptive act or practice | |
17 | 17 | under Chapter 541 for an insurer to prevent, by contract or | |
18 | 18 | otherwise, a freestanding emergency medical care facility that is a | |
19 | 19 | preferred provider from communicating with the public that the | |
20 | 20 | facility is in the insurer's preferred provider network. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2019. |
