9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 9 | | SECTION 1. Subchapter B, Chapter 2262, Government Code, is |
---|
11 | 10 | | amended by adding Section 2262.056 to read as follows: |

12 | 11 | | Sec. 2262.056. APPROVAL REQUIRED FOR ASSIGNMENT OF SERVICES |
---|
13 | 12 | | CONTRACTS. (a) In this section: |
---|
14 | 13 | | (1) "Major information resources project" has the |
---|
15 | 14 | | meaning assigned by Section 2054.003. |
---|
16 | 15 | | (2) "Sensitive personal information" has the meaning |
---|
17 | 16 | | assigned by Section 521.002, Business & Commerce Code. |
---|
18 | 17 | | (b) A vendor awarded a services contract by a state agency |
---|
19 | 18 | | may not assign the vendor's rights under the contract to a third |
---|
20 | 19 | | party unless the assignment is approved by the state agency. |
---|
21 | 20 | | (c) At least 14 days before a state agency rejects or |
---|
22 | 21 | | approves a vendor's proposed assignment under Subsection (b), the |
---|
23 | 22 | | state agency shall notify the Legislative Budget Board of the |
---|
24 | 23 | | proposed assignment if the contract subject to the assignment: |
---|
25 | 24 | | (1) is for a major information resources project; or |
---|
26 | 25 | | (2) involves storing, receiving, processing, |
---|
27 | 26 | | transmitting, disposing of, or accessing sensitive personal |
---|
28 | 27 | | information in a foreign country. |
---|
29 | 28 | | SECTION 2. The changes in law made by this Act apply only to |
---|
30 | 29 | | a contract entered into or renewed on or after the effective date of |
---|
31 | 30 | | this Act. |
---|
32 | 31 | | SECTION 3. This Act takes effect September 1, 2019. |
