65 AN ACT
76 relating to notice and approval of the assignment of vendor's
87 rights under state agency contracts for services.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Subchapter B, Chapter 2262, Government Code, is
1110 amended by adding Section 2262.056 to read as follows:
1211 Sec. 2262.056. APPROVAL REQUIRED FOR ASSIGNMENT OF SERVICES
1312 CONTRACTS. (a) In this section:
1413 (1) "Major information resources project" has the
1514 meaning assigned by Section 2054.003.
1615 (2) "Sensitive personal information" has the meaning
1716 assigned by Section 521.002, Business & Commerce Code.
1817 (b) A vendor awarded a services contract by a state agency
1918 may not assign the vendor's rights under the contract to a third
2019 party unless the assignment is approved by the state agency.
2120 (c) At least 14 days before a state agency rejects or
2221 approves a vendor's proposed assignment under Subsection (b), the
2322 state agency shall notify the Legislative Budget Board of the
2423 proposed assignment if the contract subject to the assignment:
2524 (1) is for a major information resources project; or
2625 (2) involves storing, receiving, processing,
2726 transmitting, disposing of, or accessing sensitive personal
2827 information in a foreign country.
2928 SECTION 2. The changes in law made by this Act apply only to
3029 a contract entered into or renewed on or after the effective date of
3130 this Act.
3231 SECTION 3. This Act takes effect September 1, 2019.
