44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to coverage for serious mental illness under certain group
77 health benefit plans.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1355.001, Insurance Code, is amended by
1010 amending Subdivision (1) and adding Subdivision (5) to read as
1111 follows:
1212 (1) "Serious mental illness" means the following
1313 psychiatric illnesses as defined by the American Psychiatric
1414 Association in the Diagnostic and Statistical Manual of Mental
1515 Disorders (DSM), fifth edition, or a later edition adopted by the
1616 commissioner:
1717 (A) bipolar disorders (hypomanic, manic,
1818 depressive, and mixed);
1919 (B) depression in childhood and adolescence;
2020 (C) major depressive disorders (single episode
2121 or recurrent);
2222 (D) obsessive-compulsive disorders;
2323 (E) paranoid and other psychotic disorders;
2424 (F) posttraumatic stress disorder;
2525 (G) schizo-affective disorders (bipolar or
2626 depressive); and
2727 (H) [(G)] schizophrenia.
2828 (5) "Posttraumatic stress disorder" means a disorder
2929 that:
3030 (A) meets the diagnostic criteria for
3131 posttraumatic stress disorder specified by the American
3232 Psychiatric Association in the Diagnostic and Statistical Manual of
3333 Mental Disorders, fifth edition, or a later edition adopted by the
3434 commissioner; and
3535 (B) results in an impairment of a person's
3636 functioning in the person's community, employment, family, school,
3737 or social group.
3838 SECTION 2. The heading to Section 1355.003, Insurance Code,
3939 is amended to read as follows:
4040 Sec. 1355.003. EXCEPTIONS [EXCEPTION].
4141 SECTION 3. Section 1355.003, Insurance Code, is amended by
4242 adding Subsection (c) to read as follows:
4343 (c) This subchapter, or the applicable portion of this
4444 subchapter, does not apply to a qualified health plan to the extent
4545 that a determination is made under 45 C.F.R. Section 155.170 that:
4646 (1) this subchapter or a portion of this subchapter
4747 requires the plan to offer benefits in addition to the essential
4848 health benefits required under 42 U.S.C. Section 18022(b); and
4949 (2) this state is required to defray the cost of the
5050 benefits mandated under this subchapter or a portion of this
5151 subchapter.
5252 SECTION 4. The change in law made by this Act applies only
5353 to a group health benefit plan that is delivered, issued for
5454 delivery, or renewed on or after January 1, 2018. A group health
5555 benefit plan that is delivered, issued for delivery, or renewed
5656 before January 1, 2018, is governed by the law as it existed
5757 immediately before the effective date of this Act, and that law is
5858 continued in effect for that purpose.
5959 SECTION 5. This Act takes effect September 1, 2017.
