46 AN ACT
57 relating to compensation to be paid to an emergency services
68 district for a municipality's annexation of the district's
79 territory.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 775.022, Health and Safety Code, is
10- amended by amending Subsections (c) and (e) and adding Subsections
11- (e-1) and (g) to read as follows:

1214 (c) If a municipality removes territory from a district that
1315 the municipality has annexed, the municipality shall compensate the
1416 district immediately after disannexation of the territory under
1517 Subsection (a) in an amount equal to the annexed territory's pro
1618 rata share of the district's bonded and other indebtedness as
1719 computed according to the formula in Subsection (e) or (e-1),
1820 whichever yields the greater amount. The district shall apply
1921 compensation received from a municipality under this subsection
2022 exclusively to the payment of the annexed territory's pro rata
2123 share of the district's bonded and other indebtedness.
2224 (e) Unless Subsection (e-1) would yield a greater amount,
2325 the [The] amount of compensation under Subsection (c) shall be
2426 determined by multiplying the district's total indebtedness at the
2527 time of the annexation by a fraction the numerator of which is the
2628 assessed value of the property to be annexed based on the most
2729 recent certified county property tax rolls at the time of
2830 annexation and the denominator of which is the total assessed value
2931 of the property of the district based on the most recent certified
3032 county property tax rolls at the time of annexation.
3133 (e-1) Unless Subsection (e) would yield a greater amount,
3234 the amount of compensation under Subsection (c) shall be determined
3335 by multiplying the district's total indebtedness at the time of the
3436 annexation by a fraction:
3537 (1) the numerator of which is the assessed value of the
3638 property to be annexed based on the most recent certified county
3739 property tax rolls at the time of annexation plus the total amount
3840 of the district's sales and use tax revenue collected by retailers
3941 located in the property to be annexed in the 12 months preceding the
4042 date of annexation, as reported by the comptroller; and
4143 (2) the denominator of which is the total assessed
4244 value of the property of the district based on the most recent
4345 certified county property tax rolls at the time of annexation plus
4446 the total amount of the district's sales and use tax revenue
4547 collected by retailers located in the district in the 12 months
4648 preceding the date of annexation, as reported by the comptroller.
47- (g) The amount of compensation under Subsection (c) shall be
48- determined under Subsection (e) regardless of whether Subsection
49- (e-1) would yield a greater amount if:
50- (1) the municipality is a municipality described by
51- Section 775.014(h); and
52- (2) the municipality and the district enter into an
53- agreement on or before September 1, 2019, regarding the district's
54- bonded and other indebtedness.
5549 SECTION 2. Section 8437.002(d), Special District Local Laws
5650 Code, is amended to read as follows:
5751 (d) Sections 775.022(b), (c), (d), (e), (e-1), and (f),
5852 Health and Safety Code, apply to a disannexation under this
5953 section, as if the disannexation occurred under the provisions of
6054 Section 775.022(a), Health and Safety Code.
6155 SECTION 3. Section 9036.002(d), Special District Local Laws
6256 Code, is amended to read as follows:
6357 (d) Sections 775.022(b), (c), (d), (e), (e-1), and (f),
6458 Health and Safety Code, apply to a disannexation under this
6559 section, as if the disannexation occurred under the provisions of
6660 Section 775.022(a), Health and Safety Code.
6761 SECTION 4. Section 9042.002(d), Special District Local Laws
6862 Code, is amended to read as follows:
6963 (d) Sections 775.022(b), (c), (d), (e), (e-1), and (f),
7064 Health and Safety Code, apply to a disannexation under this
7165 section, as if the disannexation occurred under the provisions of
7266 Section 775.022(a), Health and Safety Code.
7367 SECTION 5. This Act takes effect September 1, 2019.
