4	6		AN ACT
5	7		relating to compensation to be paid to an emergency services
6	8		district for a municipality's annexation of the district's
7	9		territory.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Section 775.022, Health and Safety Code, is
10		-	amended by amending Subsections (c) and (e) and adding ~~Subsections~~
11		-	(e-1~~) and (g~~) to read as follows:

12	14		(c) If a municipality removes territory from a district that
13	15		the municipality has annexed, the municipality shall compensate the
14	16		district immediately after disannexation of the territory under
15	17		Subsection (a) in an amount equal to the annexed territory's pro
16	18		rata share of the district's bonded and other indebtedness as
17	19		computed according to the formula in Subsection (e) or (e-1),
18	20		whichever yields the greater amount. The district shall apply
19	21		compensation received from a municipality under this subsection
20	22		exclusively to the payment of the annexed territory's pro rata
21	23		share of the district's bonded and other indebtedness.
22	24		(e) Unless Subsection (e-1) would yield a greater amount,
23	25		the [The] amount of compensation under Subsection (c) shall be
24	26		determined by multiplying the district's total indebtedness at the
25	27		time of the annexation by a fraction the numerator of which is the
26	28		assessed value of the property to be annexed based on the most
27	29		recent certified county property tax rolls at the time of
28	30		annexation and the denominator of which is the total assessed value
29	31		of the property of the district based on the most recent certified
30	32		county property tax rolls at the time of annexation.
31	33		(e-1) Unless Subsection (e) would yield a greater amount,
32	34		the amount of compensation under Subsection (c) shall be determined
33	35		by multiplying the district's total indebtedness at the time of the
34	36		annexation by a fraction:
35	37		(1) the numerator of which is the assessed value of the
36	38		property to be annexed based on the most recent certified county
37	39		property tax rolls at the time of annexation plus the total amount
38	40		of the district's sales and use tax revenue collected by retailers
39	41		located in the property to be annexed in the 12 months preceding the
40	42		date of annexation, as reported by the comptroller; and
41	43		(2) the denominator of which is the total assessed
42	44		value of the property of the district based on the most recent
43	45		certified county property tax rolls at the time of annexation plus
44	46		the total amount of the district's sales and use tax revenue
45	47		collected by retailers located in the district in the 12 months
46	48		preceding the date of annexation, as reported by the comptroller.
47		-	(g) The amount of compensation under Subsection (c) shall be
48		-	determined under Subsection (e) regardless of whether Subsection
49		-	(e-1) would yield a greater amount if:
50		-	(1) the municipality is a municipality described by
51		-	Section 775.014(h); and
52		-	(2) the municipality and the district enter into an
53		-	agreement on or before September 1, 2019, regarding the district's
54		-	bonded and other indebtedness.
55	49		SECTION 2. Section 8437.002(d), Special District Local Laws
56	50		Code, is amended to read as follows:
57	51		(d) Sections 775.022(b), (c), (d), (e), (e-1), and (f),
58	52		Health and Safety Code, apply to a disannexation under this
59	53		section, as if the disannexation occurred under the provisions of
60	54		Section 775.022(a), Health and Safety Code.
61	55		SECTION 3. Section 9036.002(d), Special District Local Laws
62	56		Code, is amended to read as follows:
63	57		(d) Sections 775.022(b), (c), (d), (e), (e-1), and (f),
64	58		Health and Safety Code, apply to a disannexation under this
65	59		section, as if the disannexation occurred under the provisions of
66	60		Section 775.022(a), Health and Safety Code.
67	61		SECTION 4. Section 9042.002(d), Special District Local Laws
68	62		Code, is amended to read as follows:
69	63		(d) Sections 775.022(b), (c), (d), (e), (e-1), and (f),
70	64		Health and Safety Code, apply to a disannexation under this
71	65		section, as if the disannexation occurred under the provisions of
72	66		Section 775.022(a), Health and Safety Code.
73	67		SECTION 5. This Act takes effect September 1, 2019.
