44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the entitlement of spouses of certain veterans with
77 disabilities to a veteran's employment preference.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 657.002, Government Code, is amended to
1010 read as follows:
1111 Sec. 657.002. INDIVIDUALS QUALIFIED FOR VETERAN'S
1212 EMPLOYMENT PREFERENCE. The following individuals qualify for a
1313 veteran's employment preference:
1414 (1) a veteran, including a veteran with a disability;
1515 (2) a veteran's surviving spouse who has not
1616 remarried; [and]
1717 (3) an orphan of a veteran if the veteran was killed
1818 while on active duty; and
1919 (4) the spouse of a veteran with a disability who has a
2020 total disability rating based either on having a service-connected
2121 disability with a disability rating of 100 percent or on individual
2222 unemployability and who is receiving Supplemental Security Income
2323 (SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
2424 Security Disability Insurance (SSDI) benefits under 42 U.S.C.
2525 Section 401 et seq., if the spouse was married to the veteran at the
2626 time the veteran separated from the armed services.
2727 SECTION 2. Section 657.003(b), Government Code, is amended
2828 to read as follows:
2929 (b) A state agency shall provide to an individual entitled
3030 to a veteran's employment preference for employment or appointment
3131 over other applicants for the same position who do not have a
3232 greater qualification a veteran's employment preference, in the
3333 following order of priority:
3434 (1) a veteran with a disability;
3535 (2) a veteran;
3636 (3) a spouse of a veteran with a disability as
3737 described by Section 657.002(4);
3838 (4) a veteran's surviving spouse who has not
3939 remarried; and
4040 (5) [(4)] an orphan of a veteran if the veteran was
4141 killed while on active duty.
4242 SECTION 3. Section 657.005(b), Government Code, is amended
4343 to read as follows:
4444 (b) An applicant who is either a veteran with a disability
4545 or a spouse of a veteran with a disability as described by Section
4646 657.002(4) shall furnish the official records to the individual
4747 whose duty is to fill the position.
4848 SECTION 4. The changes in law made by this Act apply only to
4949 an open position with a state agency for which the state agency
5050 begins accepting applications on or after the effective date of
5151 this Act. An open position with a state agency for which the state
5252 agency begins accepting applications before the effective date of
5353 this Act is governed by the law in effect on the date the state
5454 agency began accepting applications, and the former law is
5555 continued in effect for that purpose.
5656 SECTION 5. This Act takes effect September 1, 2017.
