57 relating to certain contracts requiring competitive bidding by the
68 Texas Department of Transportation.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 223.001, Transportation Code, is amended
911 to read as follows:
1012 Sec. 223.001. CONTRACT REQUIRING COMPETITIVE BIDS.
1113 (a) This section applies only to a highway that is part of the
1214 state highway system.
1315 (b) The department shall submit for competitive bids each
1416 contract for:
1517 (1) the improvement of a highway [that is part of the
1618 state highway system]; [or]
1719 (2) materials to be used in the construction or
1820 maintenance of a [that] highway; or
1921 (3) traffic control or safety devices to be used on a
2022 highway.
2123 SECTION 2. This Act applies only in relation to a contract
2224 for which the Texas Department of Transportation first advertises
2325 or otherwise solicits bids, proposals, offers, or qualifications on
2426 or after the effective date of this Act.
2527 SECTION 3. This Act takes effect immediately if it receives
2628 a vote of two-thirds of all the members elected to each house, as
2729 provided by Section 39, Article III, Texas Constitution. If this
2830 Act does not receive the vote necessary for immediate effect, this
2931 Act takes effect September 1, 2019.
