| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 223.001, Transportation Code, is amended |
|---|
| 9 | 11 | | to read as follows: |
|---|
| 10 | 12 | | Sec. 223.001. CONTRACT REQUIRING COMPETITIVE BIDS. |
|---|
| 11 | 13 | | (a) This section applies only to a highway that is part of the |
|---|
| 12 | 14 | | state highway system. |
|---|
| 13 | 15 | | (b) The department shall submit for competitive bids each |
|---|
| 14 | 16 | | contract for: |
|---|
| 15 | 17 | | (1) the improvement of a highway [that is part of the |
|---|
| 16 | 18 | | state highway system]; [or] |
|---|
| 17 | 19 | | (2) materials to be used in the construction or |
|---|
| 18 | 20 | | maintenance of a [that] highway; or |
|---|
| 19 | 21 | | (3) traffic control or safety devices to be used on a |
|---|
| 20 | 22 | | highway. |
|---|
| 21 | 23 | | SECTION 2. This Act applies only in relation to a contract |
|---|
| 22 | 24 | | for which the Texas Department of Transportation first advertises |
|---|
| 23 | 25 | | or otherwise solicits bids, proposals, offers, or qualifications on |
|---|
| 24 | 26 | | or after the effective date of this Act. |
|---|
| 25 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 31 | | Act takes effect September 1, 2019. |
