55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the delivery of Medicaid benefits to certain medically
88 dependent children with private health benefits coverage.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 533.0025(b), Government Code, is amended
1111 to read as follows:
1212 (b) Except as otherwise provided by this section and Section
1313 32.042421, Human Resources Code, and notwithstanding any other law,
1414 the commission shall provide Medicaid acute care services through
1515 the most cost-effective model of Medicaid capitated managed care as
1616 determined by the commission. The commission shall require
1717 mandatory participation in a Medicaid capitated managed care
1818 program for all persons eligible for Medicaid acute care benefits,
1919 but may implement alternative models or arrangements, including a
2020 traditional fee-for-service arrangement, if the commission
2121 determines the alternative would be more cost-effective or
2222 efficient.
2323 SECTION 2. Sections 533.00253(b) and (d), Government Code,
2424 are amended to read as follows:
2525 (b) Except as provided by Section 32.042421, Human
2626 Resources Code, and subject [Subject] to Section 533.0025, the
2727 commission shall operate [, in consultation with the Children's
2828 Policy Council established under Section 22.035, Human Resources
2929 Code, establish] a mandatory STAR Kids capitated managed care
3030 program tailored to provide Medicaid benefits to children with
3131 disabilities. The managed care program [developed] under this
3232 section must:
3333 (1) provide Medicaid benefits that are customized to
3434 meet the health care needs of recipients under the program through a
3535 defined system of care;
3636 (2) better coordinate care of recipients under the
3737 program;
3838 (3) improve the health outcomes of recipients;
3939 (4) improve recipients' access to health care
4040 services;
4141 (5) achieve cost containment and cost efficiency;
4242 (6) reduce the administrative complexity of
4343 delivering Medicaid benefits;
4444 (7) reduce the incidence of unnecessary
4545 institutionalizations and potentially preventable events by
4646 ensuring the availability of appropriate services and care
4747 management;
4848 (8) require a health home; and
4949 (9) coordinate and collaborate with long-term care
5050 service providers and long-term care management providers, if
5151 recipients are receiving long-term services and supports outside of
5252 the managed care organization.
5353 (d) The commission shall provide Medicaid benefits through
5454 the STAR Kids managed care program operated [established] under
5555 this section to children who are receiving benefits under the
5656 medically dependent children (MDCP) waiver program, except that the
5757 parent or guardian of a medically dependent child may opt the child
5858 out of receiving benefits through the STAR Kids managed care
5959 program and instead have the child receive benefits in accordance
6060 with Section 32.042421, Human Resources Code. The commission shall
6161 ensure that the STAR Kids managed care program provides all of the
6262 benefits provided under the medically dependent children (MDCP)
6363 waiver program to the extent necessary to implement this
6464 subsection.
6565 SECTION 3. Section 32.0212, Human Resources Code, is
6666 amended to read as follows:
6767 Sec. 32.0212. DELIVERY OF MEDICAL ASSISTANCE. Except as
6868 provided by Section 32.042421 and notwithstanding
6969 [Notwithstanding] any other law [and subject to Section 533.0025,
7070 Government Code], the commission shall provide medical assistance
7171 for acute care services through the Medicaid managed care system in
7272 accordance with [implemented under] Chapter 533, Government Code,
7373 or another Medicaid capitated managed care program.
7474 SECTION 4. Subchapter B, Chapter 32, Human Resources Code,
7575 is amended by adding Section 32.042421 to read as follows:
7676 Sec. 32.042421. DELIVERY OF MEDICAL ASSISTANCE TO CERTAIN
7777 MEDICALLY DEPENDENT CHILDREN WITH PRIVATE HEALTH BENEFITS
7878 COVERAGE. (a) The commission shall establish a program to provide
7979 medical assistance benefits under a fee-for-service delivery model
8080 to a recipient who:
8181 (1) has private health benefits coverage, including a
8282 recipient participating in the health insurance premium payment
8383 program under Section 32.0422; and
8484 (2) is a child receiving benefits under the medically
8585 dependent children (MDCP) waiver program.
8686 (b) In establishing a program under this section, the
8787 commission shall ensure that the medical assistance program is the
8888 secondary payor for covered benefits after application of the
8989 private health benefits coverage.
9090 (c) The executive commissioner shall adopt rules necessary
9191 to implement this section.
9292 SECTION 5. If before implementing any provision of this Act
9393 a state agency determines that a waiver or authorization from a
9494 federal agency is necessary for implementation of that provision,
9595 the agency affected by the provision shall request the waiver or
9696 authorization and may delay implementing that provision until the
9797 waiver or authorization is granted.
9898 SECTION 6. This Act takes effect September 1, 2019.
