| 7 | 7 | | relating to the transfer of a student from the school district of |

| 8 | 8 | | the student's residence to another district. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.036, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) Any child, other than a high school graduate, who is |
|---|
| 14 | 14 | | younger than 21 years of age and eligible for enrollment on |
|---|
| 15 | 15 | | September 1 of any school year may transfer [annually] from the |
|---|
| 16 | 16 | | child's school district of residence to another district in this |
|---|
| 17 | 17 | | state if both the receiving district and the applicant parent or |
|---|
| 18 | 18 | | [guardian or] person standing in parental relation to [having |
|---|
| 19 | 19 | | lawful control of] the child jointly approve and timely agree in |
|---|
| 20 | 20 | | writing to the transfer. |
|---|
| 21 | 21 | | (c) The transfer agreement must authorize the receiving |
|---|
| 22 | 22 | | school district or the parent or person standing in parental |
|---|
| 23 | 23 | | relation to the child who executes a transfer agreement to |
|---|
| 24 | 24 | | terminate the agreement at any time during the school year. |
|---|
| 25 | 25 | | SECTION 2. This Act applies beginning with the 2019-2020 |
|---|
| 26 | 26 | | school year. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2019. |
