55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transfer of a student from the school district of
88 the student's residence to another district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.036, Education Code, is amended by
1111 amending Subsection (a) and adding Subsection (c) to read as
1212 follows:
1313 (a) Any child, other than a high school graduate, who is
1414 younger than 21 years of age and eligible for enrollment on
1515 September 1 of any school year may transfer [annually] from the
1616 child's school district of residence to another district in this
1717 state if both the receiving district and the applicant parent or
1818 [guardian or] person standing in parental relation to [having
1919 lawful control of] the child jointly approve and timely agree in
2020 writing to the transfer.
2121 (c) The transfer agreement must authorize the receiving
2222 school district or the parent or person standing in parental
2323 relation to the child who executes a transfer agreement to
2424 terminate the agreement at any time during the school year.
2525 SECTION 2. This Act applies beginning with the 2019-2020
2626 school year.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2019.
