7 | 7 | | relating to the study and prevention of opioid overdoses occurring |
---|
8 | 8 | | in this state. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 1001, Health and Safety Code, is amended |
---|
11 | 11 | | by adding Subchapter K to read as follows: |
---|
12 | 12 | | SUBCHAPTER K. OPIOID OVERDOSES |
---|
13 | 13 | | Sec. 1001.261. OPIOID OVERDOSE STUDY. (a) The department |
---|
14 | 14 | | shall use vital statistics information and any other relevant data |
---|
15 | 15 | | maintained by or available to the department to conduct an ongoing |
---|
16 | 16 | | study on opioid overdoses occurring in this state. |
---|
17 | 17 | | (b) The department shall examine and investigate all |
---|
18 | 18 | | relevant aspects of opioid overdoses, including: |
---|
19 | 19 | | (1) the specific opioids responsible for overdoses and |
---|
20 | 20 | | deaths; |
---|
21 | 21 | | (2) the populations most vulnerable to opioid misuse; |
---|
22 | 22 | | and |
---|
23 | 23 | | (3) the regions of the state most affected by adverse |
---|
24 | 24 | | impacts related to opioid misuse. |
---|
25 | 25 | | (c) The department shall regularly update and make |
---|
26 | 26 | | available on the department's Internet website the findings of the |
---|
27 | 27 | | study, except that the department may not publicly disclose the |
---|
28 | 28 | | identity of any patient, health care provider, or health care |
---|
29 | 29 | | facility. |
---|
30 | 30 | | Sec. 1001.262. PLAN. (a) Based on the investigation and |
---|
31 | 31 | | study under Section 1001.261, the department, under the direction |
---|
32 | 32 | | of the commission and in consultation with appropriate agencies, |
---|
33 | 33 | | shall develop and periodically revise a state plan for the |
---|
34 | 34 | | prevention of opioid overdoses and opioid-related deaths in the |
---|
35 | 35 | | populations most vulnerable to opioid misuse leading to death and |
---|
36 | 36 | | within the most affected regions. |
---|
37 | 37 | | (b) The department shall review and modify as necessary the |
---|
38 | 38 | | state plan developed under this section at least once every five |
---|
39 | 39 | | years. |
---|
40 | 40 | | (c) The department shall biennially submit to the |
---|
41 | 41 | | legislature updated legislative recommendations developed under |
---|
42 | 42 | | this section. |
---|
43 | 43 | | Sec. 1001.263. COOPERATION WITH LOCAL GOVERNMENTS. The |
---|
44 | 44 | | department shall make statistics concerning opioid misuse |
---|
45 | 45 | | available to affected local governments and shall, to the extent |
---|
46 | 46 | | appropriate, share with those governments information concerning |
---|
47 | 47 | | community approaches and best practices for reducing opioid misuse |
---|
48 | 48 | | and opioid-related deaths. |
---|
49 | 49 | | SECTION 2. The Department of State Health Services shall |
---|
50 | 50 | | submit to the legislature the department's initial plan and |
---|
51 | 51 | | legislative recommendations under Section 1001.262, Health and |
---|
52 | 52 | | Safety Code, as added by this Act, not later than November 1, 2022. |
---|
53 | 53 | | SECTION 3. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2019. |
