66 AN ACT
77 relating to the study and prevention of opioid overdoses occurring
88 in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1001, Health and Safety Code, is amended
1111 by adding Subchapter K to read as follows:
1212 SUBCHAPTER K. OPIOID OVERDOSES
1313 Sec. 1001.261. OPIOID OVERDOSE STUDY. (a) The department
1414 shall use vital statistics information and any other relevant data
1515 maintained by or available to the department to conduct an ongoing
1616 study on opioid overdoses occurring in this state.
1717 (b) The department shall examine and investigate all
1818 relevant aspects of opioid overdoses, including:
1919 (1) the specific opioids responsible for overdoses and
2020 deaths;
2121 (2) the populations most vulnerable to opioid misuse;
2222 and
2323 (3) the regions of the state most affected by adverse
2424 impacts related to opioid misuse.
2525 (c) The department shall regularly update and make
2626 available on the department's Internet website the findings of the
2727 study, except that the department may not publicly disclose the
2828 identity of any patient, health care provider, or health care
2929 facility.
3030 Sec. 1001.262. PLAN. (a) Based on the investigation and
3131 study under Section 1001.261, the department, under the direction
3232 of the commission and in consultation with appropriate agencies,
3333 shall develop and periodically revise a state plan for the
3434 prevention of opioid overdoses and opioid-related deaths in the
3535 populations most vulnerable to opioid misuse leading to death and
3636 within the most affected regions.
3737 (b) The department shall review and modify as necessary the
3838 state plan developed under this section at least once every five
3939 years.
4040 (c) The department shall biennially submit to the
4141 legislature updated legislative recommendations developed under
4242 this section.
4343 Sec. 1001.263. COOPERATION WITH LOCAL GOVERNMENTS. The
4444 department shall make statistics concerning opioid misuse
4545 available to affected local governments and shall, to the extent
4646 appropriate, share with those governments information concerning
4747 community approaches and best practices for reducing opioid misuse
4848 and opioid-related deaths.
4949 SECTION 2. The Department of State Health Services shall
5050 submit to the legislature the department's initial plan and
5151 legislative recommendations under Section 1001.262, Health and
5252 Safety Code, as added by this Act, not later than November 1, 2022.
5353 SECTION 3. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2019.
