65 AN ACT
76 relating to the establishment of a border public health initiative
87 by the Department of State Health Services.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Subtitle C, Title 2, Health and Safety Code, is
1110 amended by adding Chapter 65 to read as follows:
1211 CHAPTER 65. BORDER PUBLIC HEALTH INITIATIVE
1312 Sec. 65.0001. DEFINITIONS. In this chapter:
1413 (1) "Border county" means a county adjacent to this
1514 state's international border with Mexico.
1615 (2) "Promotora" or "community health worker" has the
1716 meaning assigned by Section 48.001.
1817 Sec. 65.0002. BORDER PUBLIC HEALTH INITIATIVE. (a) The
1918 department shall develop an initiative to reduce the adverse health
2019 impacts of diabetes, hypertension, and obesity for adults and
2120 children in border counties. The initiative must promote:
2221 (1) educational resources designed to prevent those
2322 conditions;
2423 (2) screenings of persons at risk for those
2524 conditions; and
2625 (3) referrals to and treatment by health care
2726 providers for those conditions.
2827 (b) In developing the border public health initiative, the
2928 department may consult and collaborate with:
3029 (1) other health and human services agencies;
3130 (2) other appropriate state or federal agencies;
3231 (3) health science centers and medical schools; and
3332 (4) public and private health care providers and
3433 hospitals.
3534 Sec. 65.0003. OUTREACH CAMPAIGNS. To implement the border
3635 public health initiative described by Section 65.0002, the
3736 department shall conduct bilingual, culturally appropriate
3837 outreach campaigns in consultation and collaboration with
3938 appropriate individuals and entities that may include:
4039 (1) promotoras and community health workers;
4140 (2) academic centers located in border counties;
4241 (3) nonprofit organizations;
4342 (4) public schools;
4443 (5) public and private health care providers and
4544 hospitals;
4645 (6) worksite wellness programs;
4746 (7) local business and health care providers that
4847 provide early detection of prediabetes, prehypertension, and
4948 obesity; and
5049 (8) other local entities, as the department determines
5150 appropriate.
5251 Sec. 65.0004. REPORT. Not later than January 1, 2023, the
5352 department shall prepare and electronically submit to the
5453 lieutenant governor, the speaker of the house of representatives,
5554 and the legislature a report describing:
5655 (1) health outcomes and health care savings resulting
5756 from prevention, screenings, and treatment of chronic diseases
5857 under the border public health initiative; and
5958 (2) other relevant findings, as determined by the
6059 department, resulting from the border public health initiative.
6160 Sec. 65.0005. EXPIRATION. This chapter expires December
6261 31, 2031.
6362 SECTION 2. The Department of State Health Services is
6463 required to implement a provision of this Act only if the
6564 legislature appropriates money specifically for that purpose. If
6665 the legislature does not appropriate money specifically for that
6766 purpose, the department may, but is not required to, implement a
6867 provision of this Act using other appropriations available for that
6968 purpose.
7069 SECTION 3. This Act takes effect September 1, 2019.
