65 AN ACT
76 relating to health professional continuing education to address
87 communicable and other diseases in border counties.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Chapter 81, Health and Safety Code, is amended by
1110 adding Subchapter K to read as follows:
1211 SUBCHAPTER K. HEALTH PROFESSIONAL CONTINUING EDUCATION TO ADDRESS
1312 COMMUNICABLE AND OTHER DISEASES IN BORDER COUNTIES
1413 Sec. 81.451. DEFINITIONS. In this subchapter:
1514 (1) "Community health worker" has the meaning assigned
1615 by Section 48.001.
1716 (2) "Health professional" means an individual whose:
1817 (A) vocation or profession is directly or
1918 indirectly related to the maintenance of the health of another
2019 individual; and
2120 (B) duties require a specified amount of formal
2221 education and may require a special examination, certificate or
2322 license, or membership in a regional or national association.
2423 (3) "HIV" means human immunodeficiency virus.
2524 Sec. 81.452. APPLICABILITY OF SUBCHAPTER. This subchapter
2625 applies only to a county adjacent to the international border with
2726 Mexico.
2827 Sec. 81.453. HEALTH PROFESSIONAL CONTINUING EDUCATION.
2928 (a) To the extent funds are available, the department, in
3029 collaboration with health authorities, local health departments,
3130 and public health districts, shall provide to community health
3231 workers, health professionals, and applicable employees of a local
3332 health department or public health district continuing education
3433 designed to reduce the incidence of communicable and other diseases
3534 in counties described by Section 81.452.
3635 (b) The continuing education described by Subsection (a)
3736 may address:
3837 (1) the diagnosis and treatment of communicable and
3938 other diseases, including:
4039 (A) tuberculosis, tuberculosis meningitis,
4140 multidrug resistant tuberculosis, and tuberculosis and HIV
4241 coinfections;
4342 (B) sexually transmitted diseases and HIV; and
4443 (C) liver diseases;
4544 (2) methods for increasing pediatric and adult
4645 immunization rates;
4746 (3) strategies for improving health care system
4847 operations related to public health, including identifying,
4948 monitoring, tracking, and responding to communicable and other
5049 diseases occurring in the counties described by Section 81.452; and
5150 (4) any other matter that the department determines
5251 will assist health professionals, local health departments, and
5352 public health districts with addressing public health challenges
5453 existing in those counties.
5554 (c) The department shall identify and assess the
5655 accessibility of continuing education resources and programs for
5756 local health departments in counties described by Section 81.452
5857 that may provide the continuing education described by this
5958 section.
6059 Sec. 81.454. FUNDING. (a) The department may solicit or
6160 accept gifts, grants, or donations to fund health professional
6261 continuing education under this subchapter.
6362 (b) The department shall collaborate with state and federal
6463 agencies, nonprofit organizations, public and private hospitals,
6564 institutions of higher education, and the private sector to
6665 identify, apply for, and solicit sources of funding for health
6766 professional continuing education under this subchapter.
6867 SECTION 2. The Department of State Health Services is
6968 required to implement a provision of this Act only if the
7069 legislature appropriates money specifically for that purpose. If
7170 the legislature does not appropriate money specifically for that
7271 purpose, the department may, but is not required to, implement a
7372 provision of this Act using other appropriations available for that
7473 purpose.
7574 SECTION 3. This Act takes effect September 1, 2019.
