7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 62.051, Labor Code, is amended to read as | |
9 | 9 | follows: | |
10 | 10 | Sec. 62.051. MINIMUM WAGE. Except as provided by Section | |
11 | 11 | 62.057, an employer shall pay to each employee not less than the | |
12 | 12 | greater of: | |
13 | 13 | (1) $10.10 an hour; or | |
14 | 14 | (2) the federal minimum wage under Section 6, Fair | |
15 | 15 | Labor Standards Act of 1938 (29 U.S.C. Section 206). | |
16 | 16 | SECTION 2. Section 62.151, Labor Code, is repealed. | |
17 | 17 | SECTION 3. This Act takes effect December 1, 2017, but | |
18 | 18 | only if the constitutional amendment proposed by the 85th | |
19 | 19 | Legislature, Regular Session, 2017, establishing a minimum wage | |
20 | 20 | of the greater of $10.10 an hour or the federal minimum wage is | |
21 | 21 | approved by the voters. If that proposed constitutional | |
22 | 22 | amendment is not approved by the voters, this Act has no effect. |
