11 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 11 | | SECTION 1. Subchapter I, Chapter 2001, Government Code, is |
---|
13 | 12 | | amended by adding Section 2001.227 to read as follows: |
---|
14 | 13 | | Sec. 2001.227. TEXAS CIVIL COMMITMENT OFFICE. This chapter |
---|
15 | 14 | | does not: |
---|
16 | 15 | | (1) apply to a rule of the Texas Civil Commitment |
---|
17 | 16 | | Office that applies to a person who is civilly committed as a |
---|
18 | 17 | | sexually violent predator under Chapter 841, Health and Safety |
---|
19 | 18 | | Code; or |
---|
20 | 19 | | (2) entitle any person to judicial review of any |
---|
21 | 20 | | decision made or action taken under a rule described by Subdivision |
---|
22 | 21 | | (1). |
---|
23 | 22 | | SECTION 2. Section 841.0837, Health and Safety Code, is |
---|
24 | 23 | | amended to read as follows: |
---|
25 | 24 | | Sec. 841.0837. EMERGENCY DETENTION ORDER. The [(a) In this |
---|
26 | 25 | | section, "peace officer" has the meaning assigned by Article 2.12, |
---|
27 | 26 | | Code of Criminal Procedure. |
---|
28 | 27 | | [(b) For the purpose of returning a committed person to a |
---|
29 | 28 | | more restrictive setting following a transfer to less restrictive |
---|
30 | 29 | | housing and supervision under Section 841.0834 or a release under |
---|
31 | 30 | | Section 841.0836, the] office may issue an emergency detention |
---|
32 | 31 | | order for a committed [the] person's immediate apprehension and |
---|
33 | 32 | | transportation to an office-designated [a] location for the purpose |
---|
34 | 33 | | of: |
---|
35 | 34 | | (1) returning the person to a more restrictive setting |
---|
36 | 35 | | following: |
---|
37 | 36 | | (A) a transfer to less restrictive housing and |
---|
38 | 37 | | supervision under Section 841.0834; or |
---|
39 | 38 | | (B) a release under Section 841.0836; or |
---|
40 | 39 | | (2) for a recently committed person who is not in the |
---|
41 | 40 | | custody of the Texas Department of Criminal Justice at the time the |
---|
42 | 41 | | commitment order is entered, bringing the person under the |
---|
43 | 42 | | supervision of [designated by] the office. |
---|
44 | 43 | | SECTION 3. Section 841.084, Health and Safety Code, is |
---|
45 | 44 | | amended by adding Subsection (c) to read as follows: |
---|
46 | 45 | | (c) A committed person, on request, shall provide to the |
---|
47 | 46 | | office any financial records or other information regarding the |
---|
48 | 47 | | person's income, assets, and expenses to assist the office in |
---|
49 | 48 | | determining whether the person is indigent for purposes of this |
---|
50 | 49 | | section. |
---|
51 | 50 | | SECTION 4. This Act takes effect September 1, 2019. |
