54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to the powers and duties of the Texas Civil Commitment
87 Office and to certain requirements regarding the payment of costs
98 associated with civil commitment by persons civilly committed as
109 sexually violent predators.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Subchapter I, Chapter 2001, Government Code, is
1312 amended by adding Section 2001.227 to read as follows:
1413 Sec. 2001.227. TEXAS CIVIL COMMITMENT OFFICE. This chapter
1514 does not:
1615 (1) apply to a rule of the Texas Civil Commitment
1716 Office that applies to a person who is civilly committed as a
1817 sexually violent predator under Chapter 841, Health and Safety
1918 Code; or
2019 (2) entitle any person to judicial review of any
2120 decision made or action taken under a rule described by Subdivision
2221 (1).
2322 SECTION 2. Section 841.0837, Health and Safety Code, is
2423 amended to read as follows:
2524 Sec. 841.0837. EMERGENCY DETENTION ORDER. The [(a) In this
2625 section, "peace officer" has the meaning assigned by Article 2.12,
2726 Code of Criminal Procedure.
2827 [(b) For the purpose of returning a committed person to a
2928 more restrictive setting following a transfer to less restrictive
3029 housing and supervision under Section 841.0834 or a release under
3130 Section 841.0836, the] office may issue an emergency detention
3231 order for a committed [the] person's immediate apprehension and
3332 transportation to an office-designated [a] location for the purpose
3433 of:
3534 (1) returning the person to a more restrictive setting
3635 following:
3736 (A) a transfer to less restrictive housing and
3837 supervision under Section 841.0834; or
3938 (B) a release under Section 841.0836; or
4039 (2) for a recently committed person who is not in the
4140 custody of the Texas Department of Criminal Justice at the time the
4241 commitment order is entered, bringing the person under the
4342 supervision of [designated by] the office.
4443 SECTION 3. Section 841.084, Health and Safety Code, is
4544 amended by adding Subsection (c) to read as follows:
4645 (c) A committed person, on request, shall provide to the
4746 office any financial records or other information regarding the
4847 person's income, assets, and expenses to assist the office in
4948 determining whether the person is indigent for purposes of this
5049 section.
5150 SECTION 4. This Act takes effect September 1, 2019.
