66 AN ACT
77 relating to the payment of insurance deductibles related to
88 property insurance policies; creating criminal offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 5, Insurance Code, is amended
1111 by adding Chapter 707 to read as follows:
1212 CHAPTER 707. PAYMENT OF INSURANCE DEDUCTIBLE
1313 Sec. 707.001. DEFINITIONS. In this chapter:
1414 (1) "Person" means an individual, corporation,
1515 association, partnership, limited liability company, or other
1616 legal entity.
1717 (2) "Property insurance" means insurance that
1818 provides coverage for loss of or damage to real or personal
1919 property.
2020 Sec. 707.002. PAYMENT OF DEDUCTIBLE REQUIRED. A person
2121 insured under a property insurance policy shall pay any deductible
2222 applicable to a first-party claim made under the policy.
2323 Sec. 707.003. CONSUMER EDUCATION. The department shall
2424 develop and implement an education program related to the payment
2525 of property insurance deductibles. The program must:
2626 (1) provide reasonable methods to educate insurance
2727 consumers and providers of goods or services that are regularly
2828 paid for from proceeds of property insurance claims; and
2929 (2) include materials regarding:
3030 (A) the requirements of this chapter; and
3131 (B) the conduct prohibited by Section 707.006.
3232 Sec. 707.004. REQUIRED CONTRACT NOTICE. A contract to
3333 provide a good or service that is reasonably expected to be paid
3434 wholly or partly from the proceeds of a claim under a property
3535 insurance policy and that has a contract price of $1,000 or more
3636 must contain the following notice in at least 12-point boldfaced
3737 type: "Texas law requires a person insured under a property
3838 insurance policy to pay any deductible applicable to a claim made
3939 under the policy. It is a violation of Texas law for a person or
4040 business paid wholly or partly from proceeds of a property
4141 insurance claim to knowingly allow the policyholder to fail to pay,
4242 or assist the policyholder's failure to pay, the applicable
4343 insurance deductible."
4444 Sec. 707.005. PROOF OF PAYMENT. (a) This section applies
4545 to any insurer that issues a policy providing coverage for loss of
4646 or damage to real or personal property, including a county mutual
4747 insurance company, a farm mutual insurance company, a reciprocal or
4848 interinsurance exchange, or a Lloyd's plan.
4949 (b) An insurer that issues a property insurance policy with
5050 replacement cost coverage may refuse to pay a claim for replacement
5151 cost under the policy until the insurer receives reasonable proof
5252 of payment by the policyholder of any deductible applicable to the
5353 claim.
5454 Sec. 707.006. OFFENSES. (a) A person who sells goods or
5555 services commits an offense if the person:
5656 (1) advertises or promises to provide a good or
5757 service to an insured under a property insurance policy in a
5858 transaction in which:
5959 (A) the good or service will be paid for by the
6060 insured from the proceeds of a property insurance claim; and
6161 (B) the person selling the good or service will,
6262 without the insurer's consent:
6363 (i) pay, waive, absorb, or otherwise
6464 decline to charge or collect the amount of the insured's
6565 deductible;
6666 (ii) provide a rebate or credit in
6767 connection with the sale of the good or service that will offset all
6868 or part of the amount paid by the insured as a deductible; or
6969 (iii) in any other manner assist the
7070 insured in avoiding monetary payment of the required insurance
7171 deductible; or
7272 (2) provides a good or service to an insured under a
7373 property insurance policy knowing that the insured will pay for the
7474 good or service with the proceeds of a claim under the policy and,
7575 without the insurer's consent:
7676 (A) pays, waives, absorbs, or otherwise declines
7777 to charge or collect the amount of the insured's deductible;
7878 (B) provides a rebate or credit in connection
7979 with the sale of the good or service that offsets all or part of the
8080 amount paid by the insured as a deductible; or
8181 (C) in any other manner assists the insured in
8282 avoiding monetary payment of the required insurance deductible.
8383 (b) A person insured under a property insurance policy
8484 commits an offense if the person, in connection with a first-party
8585 claim under the policy for loss of or damage to real or personal
8686 property, knowingly:
8787 (1) pays for a good or service with proceeds of the
8888 claim; and
8989 (2) without the insurer's consent:
9090 (A) fails to pay a required insurance deductible
9191 in connection with the claim; or
9292 (B) accepts a rebate or credit in connection with
9393 the purchase that offsets all or part of the amount paid by the
9494 insured as a deductible.
9595 (c) An offense under this section is a Class A misdemeanor.
9696 SECTION 2. Section 27.02, Business & Commerce Code, is
9797 repealed.
9898 SECTION 3. The repeal by this Act of Section 27.02, Business &
9999 Commerce Code, applies only to an offense committed on or after
100100 the effective date of this Act. An offense committed before the
101101 effective date of this Act is governed by the law in effect on the
102102 date the offense was committed, and the former law is continued in
103103 effect for that purpose. For purposes of this section, an offense
104104 was committed before the effective date of this Act if any element
105105 of the offense occurred before that date.
106106 SECTION 4. Section 707.004, Insurance Code, as added by
107107 this Act, applies only to a contract entered into on or after the
108108 effective date of this Act.
109109 SECTION 5. This Act takes effect September 1, 2019.
