9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 1.34, Chapter 626, Acts of the 73rd | |
11 | 11 | Legislature, Regular Session, 1993, is amended by amending | |
12 | 12 | Subsection (a) and adding Subsections (a-1), (a-2), and (a-3) to | |
13 | 13 | read as follows: | |
14 | 14 | (a) In this section, "retail public utility" has the meaning | |
15 | 15 | assigned by Chapter 13, Water Code. | |
16 | 16 | (a-1) Except as provided by this section, water [Water] | |
17 | 17 | withdrawn from the aquifer must be used within the boundaries of the | |
18 | 18 | authority. | |
19 | 19 | (a-2) A retail public utility that is an initial regular | |
20 | 20 | permit holder and the service area of which is contained wholly or | |
21 | 21 | partly inside the boundaries of the authority may use water | |
22 | 22 | withdrawn from the aquifer to provide retail water service in an | |
23 | 23 | area where the utility may provide retail water service. | |
24 | 24 | (a-3) A municipally owned utility owned by the City of San | |
25 | 25 | Antonio may sell water withdrawn from the aquifer at wholesale to a | |
26 | 26 | retail public utility or river authority for use in a county | |
27 | 27 | adjacent to the boundaries of the authority. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2019. |
