| 7 | 7 | | relating to the issuance of an occupational driver's license. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 521.242, Transportation Code, is amended |
|---|
| 10 | 10 | | by adding Subsections (b-1), (g), and (h) and amending Subsection |
|---|
| 11 | 11 | | (d) to read as follows: |
|---|
| 12 | 12 | | (b-1) A person whose driver's license is suspended under |
|---|
| 13 | 13 | | Chapter 708 or denied renewal under Chapter 706 may apply for an |
|---|
| 14 | 14 | | occupational license by filing a verified petition with the clerk |
|---|
| 15 | 15 | | of a court in which the person was convicted for an underlying |
|---|
| 16 | 16 | | offense giving rise to the license suspension or denial. |
|---|
| 17 | 17 | | (d) A petition filed under Subsection (b) or (b-1) must |
|---|
| 18 | 18 | | state that the petitioner was convicted in that court for an offense |
|---|
| 19 | 19 | | under the laws of this state. |
|---|
| 20 | 20 | | (g) A court shall notify a person at sentencing that the |
|---|
| 21 | 21 | | person may be entitled to an occupational license if: |
|---|
| 22 | 22 | | (1) the person's driver's license is automatically |
|---|
| 23 | 23 | | suspended following the conviction; |
|---|
| 24 | 24 | | (2) the person's driver's license is suspended for |
|---|
| 25 | 25 | | failure to pay surcharges associated with the conviction under |
|---|
| 26 | 26 | | Chapter 708; or |
|---|
| 27 | 27 | | (3) the person's driver's license is denied renewal |
|---|
| 28 | 28 | | under Chapter 706 for failure to pay or satisfy a judgment ordering |
|---|
| 29 | 29 | | the payment of a fine and cost in the manner ordered by the court. |
|---|
| 30 | 30 | | (h) Each justice and municipal court shall provide a |
|---|
| 31 | 31 | | standard petition form that a person may complete and file with the |
|---|
| 32 | 32 | | clerk to apply for an occupational license. The form must include |
|---|
| 33 | 33 | | instructions for obtaining a waiver of the application fee for |
|---|
| 34 | 34 | | persons who are unable to pay. |
|---|
| 35 | 35 | | SECTION 2. Section 521.2462, Transportation Code, is |
|---|
| 36 | 36 | | amended by adding Subsection (d) to read as follows: |
|---|
| 37 | 37 | | (d) This section does not apply to a person who petitioned |
|---|
| 38 | 38 | | for an occupational license solely because the person's driver's |
|---|
| 39 | 39 | | license was suspended under Chapter 708 or the person's driver's |
|---|
| 40 | 40 | | license was denied renewal under Chapter 706. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2019. |
