66 AN ACT
77 relating to the issuance of an occupational driver's license.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 521.242, Transportation Code, is amended
1010 by adding Subsections (b-1), (g), and (h) and amending Subsection
1111 (d) to read as follows:
1212 (b-1) A person whose driver's license is suspended under
1313 Chapter 708 or denied renewal under Chapter 706 may apply for an
1414 occupational license by filing a verified petition with the clerk
1515 of a court in which the person was convicted for an underlying
1616 offense giving rise to the license suspension or denial.
1717 (d) A petition filed under Subsection (b) or (b-1) must
1818 state that the petitioner was convicted in that court for an offense
1919 under the laws of this state.
2020 (g) A court shall notify a person at sentencing that the
2121 person may be entitled to an occupational license if:
2222 (1) the person's driver's license is automatically
2323 suspended following the conviction;
2424 (2) the person's driver's license is suspended for
2525 failure to pay surcharges associated with the conviction under
2626 Chapter 708; or
2727 (3) the person's driver's license is denied renewal
2828 under Chapter 706 for failure to pay or satisfy a judgment ordering
2929 the payment of a fine and cost in the manner ordered by the court.
3030 (h) Each justice and municipal court shall provide a
3131 standard petition form that a person may complete and file with the
3232 clerk to apply for an occupational license. The form must include
3333 instructions for obtaining a waiver of the application fee for
3434 persons who are unable to pay.
3535 SECTION 2. Section 521.2462, Transportation Code, is
3636 amended by adding Subsection (d) to read as follows:
3737 (d) This section does not apply to a person who petitioned
3838 for an occupational license solely because the person's driver's
3939 license was suspended under Chapter 708 or the person's driver's
4040 license was denied renewal under Chapter 706.
4141 SECTION 3. This Act takes effect September 1, 2019.
