9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 39.909(c), Utilities Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (c) Each electric utility shall submit an annual report to |
---|
13 | 13 | | the commission and the legislature relating to its efforts to |
---|
14 | 14 | | improve workforce diversity and contracting opportunities for |
---|
15 | 15 | | small and historically underutilized businesses. The report must be |
---|
16 | 16 | | submitted in electronic form on October 1 of each year or may be |
---|
17 | 17 | | included as part of any other annual report submitted by the |
---|
18 | 18 | | electric utility to the commission. The report must include: |
---|
19 | 19 | | (1) the diversity of the electric utility's workforce |
---|
20 | 20 | | as of the time of the report; |
---|
21 | 21 | | (2) the electric utility's level of contracting with |
---|
22 | 22 | | small and historically underutilized businesses; |
---|
23 | 23 | | (3) the specific progress made under the plan under |
---|
24 | 24 | | Subsection (b); |
---|
25 | 25 | | (4) the specific initiatives, programs, and |
---|
26 | 26 | | activities undertaken under the plan during the preceding year; |
---|
27 | 27 | | (5) an assessment of the success of each of those |
---|
28 | 28 | | initiatives, programs, and activities; |
---|
29 | 29 | | (6) the extent to which the electric utility has |
---|
30 | 30 | | carried out its initiatives to facilitate opportunities for |
---|
31 | 31 | | contracts or joint ventures with small and historically |
---|
32 | 32 | | underutilized businesses; and |
---|
33 | 33 | | (7) the initiatives, programs, and activities the |
---|
34 | 34 | | electric utility will pursue during the next year to increase the |
---|
35 | 35 | | diversity of its workforce and contracting opportunities for small |
---|
36 | 36 | | and historically underutilized businesses. |

37 | 37 | | SECTION 2. Section 52.256(c), Utilities Code, is amended to |
---|
38 | 38 | | read as follows: |
---|
39 | 39 | | (c) Each telecommunications utility shall submit an annual |
---|
40 | 40 | | report to the commission and the legislature relating to its |
---|
41 | 41 | | efforts to improve workforce diversity and contracting |
---|
42 | 42 | | opportunities for small and historically underutilized businesses. |
---|
43 | 43 | | The report must be submitted in electronic form and must include: |

44 | 44 | | (1) the diversity of the telecommunications utility's |
---|
