55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the submission of certain utility reports in electronic
88 form.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.909(c), Utilities Code, is amended to
1111 read as follows:
1212 (c) Each electric utility shall submit an annual report to
1313 the commission and the legislature relating to its efforts to
1414 improve workforce diversity and contracting opportunities for
1515 small and historically underutilized businesses. The report must be
1616 submitted in electronic form on October 1 of each year or may be
1717 included as part of any other annual report submitted by the
1818 electric utility to the commission. The report must include:
1919 (1) the diversity of the electric utility's workforce
2020 as of the time of the report;
2121 (2) the electric utility's level of contracting with
2222 small and historically underutilized businesses;
2323 (3) the specific progress made under the plan under
2424 Subsection (b);
2525 (4) the specific initiatives, programs, and
2626 activities undertaken under the plan during the preceding year;
2727 (5) an assessment of the success of each of those
2828 initiatives, programs, and activities;
2929 (6) the extent to which the electric utility has
3030 carried out its initiatives to facilitate opportunities for
3131 contracts or joint ventures with small and historically
3232 underutilized businesses; and
3333 (7) the initiatives, programs, and activities the
3434 electric utility will pursue during the next year to increase the
3535 diversity of its workforce and contracting opportunities for small
3636 and historically underutilized businesses.
3737 SECTION 2. Section 52.256(c), Utilities Code, is amended to
3838 read as follows:
3939 (c) Each telecommunications utility shall submit an annual
4040 report to the commission and the legislature relating to its
4141 efforts to improve workforce diversity and contracting
4242 opportunities for small and historically underutilized businesses.
4343 The report must be submitted in electronic form and must include:
4444 (1) the diversity of the telecommunications utility's
4545 workforce as of the time of the report;
4646 (2) the telecommunications utility's level of
4747 contracting with small and historically underutilized businesses;
4848 (3) the specific progress made under the plan under
4949 Subsection (b);
5050 (4) the specific initiatives, programs, and
5151 activities undertaken under the plan during the preceding year;
5252 (5) an assessment of the success of each of those
5353 initiatives, programs, and activities;
5454 (6) the extent to which the telecommunications utility
5555 has carried out its initiatives to facilitate opportunities for
5656 contracts or joint ventures with small and historically
5757 underutilized businesses; and
5858 (7) the initiatives, programs, and activities the
5959 telecommunications utility will pursue during the next year to
6060 increase the diversity of its workforce and contracting
6161 opportunities for small and historically underutilized businesses.
6262 SECTION 3. This Act takes effect September 1, 2019.
