8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 533.005, Government Code, is amended by |
---|
10 | 12 | | adding Subsection (g) to read as follows: |
---|
11 | 13 | | (g) In addition to the requirements specified by Subsection |
---|
12 | 14 | | (a), a contract described by that subsection must contain language |
---|
13 | 15 | | permitting a managed care organization to offer medically |
---|
14 | 16 | | appropriate, cost-effective, evidence-based services from a list |
---|
15 | 17 | | approved by the state Medicaid managed care advisory committee and |
---|
16 | 18 | | included in the contract in lieu of mental health or substance use |
---|
17 | 19 | | disorder services specified in the state Medicaid plan. A |
---|
18 | 20 | | recipient is not required to use a service from the list included in |
---|
19 | 21 | | the contract in lieu of another mental health or substance use |
---|
20 | 22 | | disorder service specified in the state Medicaid plan. The |
---|
21 | 23 | | commission shall: |
---|
22 | 24 | | (1) prepare and submit an annual report to the |
---|
23 | 25 | | legislature on the number of times during the preceding year a |
---|
24 | 26 | | service from the list included in the contract is used; and |
---|
25 | 27 | | (2) take into consideration the actual cost and use of |
---|
26 | 28 | | any services from the list included in the contract that are offered |
---|
27 | 29 | | by a managed care organization when setting the capitation rates |
---|
28 | 30 | | for that organization under the contract. |
---|
29 | 31 | | SECTION 2. Section 533.005, Government Code, as amended by |
---|
30 | 32 | | this Act, applies to a contract entered into or renewed on or after |
---|
31 | 33 | | the effective date of this Act. A contract entered into or renewed |
---|
32 | 34 | | before that date is governed by the law in effect on the date the |
---|
33 | 35 | | contract was entered into or renewed, and that law is continued in |
---|
34 | 36 | | effect for that purpose. |
---|
35 | 37 | | SECTION 3. If before implementing any provision of this Act |
---|
36 | 38 | | a state agency determines that a waiver or authorization from a |
---|
37 | 39 | | federal agency is necessary for implementation of that provision, |
---|
38 | 40 | | the agency affected by the provision shall request the waiver or |
---|
39 | 41 | | authorization and may delay implementing that provision until the |
---|
40 | 42 | | waiver or authorization is granted. |
---|
41 | 43 | | SECTION 4. This Act takes effect September 1, 2019. |
