46 AN ACT
57 relating to offering certain evidence-based services in lieu of
68 other mental health or substance use disorder services by a
79 Medicaid managed care organization.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 533.005, Government Code, is amended by
1012 adding Subsection (g) to read as follows:
1113 (g) In addition to the requirements specified by Subsection
1214 (a), a contract described by that subsection must contain language
1315 permitting a managed care organization to offer medically
1416 appropriate, cost-effective, evidence-based services from a list
1517 approved by the state Medicaid managed care advisory committee and
1618 included in the contract in lieu of mental health or substance use
1719 disorder services specified in the state Medicaid plan. A
1820 recipient is not required to use a service from the list included in
1921 the contract in lieu of another mental health or substance use
2022 disorder service specified in the state Medicaid plan. The
2123 commission shall:
2224 (1) prepare and submit an annual report to the
2325 legislature on the number of times during the preceding year a
2426 service from the list included in the contract is used; and
2527 (2) take into consideration the actual cost and use of
2628 any services from the list included in the contract that are offered
2729 by a managed care organization when setting the capitation rates
2830 for that organization under the contract.
2931 SECTION 2. Section 533.005, Government Code, as amended by
3032 this Act, applies to a contract entered into or renewed on or after
3133 the effective date of this Act. A contract entered into or renewed
3234 before that date is governed by the law in effect on the date the
3335 contract was entered into or renewed, and that law is continued in
3436 effect for that purpose.
3537 SECTION 3. If before implementing any provision of this Act
3638 a state agency determines that a waiver or authorization from a
3739 federal agency is necessary for implementation of that provision,
3840 the agency affected by the provision shall request the waiver or
3941 authorization and may delay implementing that provision until the
4042 waiver or authorization is granted.
4143 SECTION 4. This Act takes effect September 1, 2019.
