46 AN ACT
57 relating to eligible participants in the Texas Achieving a Better
68 Life Experience (ABLE) Program.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 54.910(b), Education Code, is amended to
911 read as follows:
1012 (b) If the designated beneficiary of the account is not able
1113 to exercise signature authority over the account, or if a
1214 designated beneficiary chooses to establish an account but not
1315 exercise signature authority [a minor or has a custodian or other
1416 fiduciary appointed for the purpose of managing the minor's
1517 financial affairs], the parent, legal guardian, [or custodian] or
1618 other fiduciary of the beneficiary may serve as the participant if
1719 [that form of ownership is] permitted [or not prohibited] by
1820 Section 529A, Internal Revenue Code.
1921 SECTION 2. This Act takes effect immediately if it receives
2022 a vote of two-thirds of all the members elected to each house, as
2123 provided by Section 39, Article III, Texas Constitution. If this
2224 Act does not receive the vote necessary for immediate effect, this
2325 Act takes effect September 1, 2019.
