| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 54.910(b), Education Code, is amended to |

| 9 | 11 | | read as follows: |

| 10 | 12 | | (b) If the designated beneficiary of the account is not able |
|---|
| 11 | 13 | | to exercise signature authority over the account, or if a |
|---|
| 12 | 14 | | designated beneficiary chooses to establish an account but not |
|---|
| 13 | 15 | | exercise signature authority [a minor or has a custodian or other |
|---|
| 14 | 16 | | fiduciary appointed for the purpose of managing the minor's |
|---|
| 15 | 17 | | financial affairs], the parent, legal guardian, [or custodian] or |
|---|
| 16 | 18 | | other fiduciary of the beneficiary may serve as the participant if |
|---|
| 17 | 19 | | [that form of ownership is] permitted [or not prohibited] by |
|---|
| 18 | 20 | | Section 529A, Internal Revenue Code. |

| 19 | 21 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 24 | | Act does not receive the vote necessary for immediate effect, this |

| 23 | 25 | | Act takes effect September 1, 2019. |
