55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment and use of performance standards for
88 certain secondary-level alternate assessment instruments
99 administered to public school students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.0241, Education Code, is amended by
1212 adding Subsection (a-2) to read as follows:
1313 (a-2) This subsection applies only to an assessment
1414 instrument authorized under Section 39.025(a-1) or Section
1515 39.025(a-2), as added by Chapter 1036 (H.B. 1613), Acts of the 84th
1616 Legislature, Regular Session, 2015, for use as an alternate
1717 assessment instrument for purposes of satisfying the requirements
1818 concerning an end-of-course assessment instrument. The
1919 commissioner shall designate performance standards for student
2020 performance on each assessment instrument subject to this
2121 subsection in the same manner as the commissioner designates
2222 performance standards for student performance on each
2323 end-of-course assessment instrument listed in Section 39.023(c).
2424 SECTION 2. Section 39.053, Education Code, is amended by
2525 adding Subsection (c-4) to read as follows:
2626 (c-4) The commissioner by rule shall determine a method for
2727 appropriately crediting a student for growth under Subsection
2828 (c)(2) based on the student's performance, as determined under the
2929 performance standards designated under Section 39.0241(a-2), on an
3030 alternate assessment instrument.
3131 SECTION 3. This Act applies beginning with the 2019-2020
3232 school year.
3333 SECTION 4. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2019.
